    Are you kidding us? I do not know what level of education you have achieved so far in your life but it looks like you are not enough educated to differentiate between the definitions of permanent residency, citizenship and perhaps working on work visa as far as legal stay in USA by outsider is concerned.

    What would be the "legal" reply from US Supreme court,if you ask US supreme court that whether citizen of other country can call US president a "My president"? . And What would be the "legal" reply from Supreme court of country A,if you ask that whether citizen of country A can call US president a "his/her president"?

    USA expects someone to abide by the land of the law while s/he come to US to work legally. And what is expected legally is one is not involved in "Anti USA" activity whatsoever it may be.USA legally never expects citizen of other country "to love" or "show fidelity" towards USA when s/he is still the citizen of other country.

    PavanV is right in his argument, in a sense, that when some person is citizen of country A at this moment his/her fidelity naturally must be for his/her country A. This is the legally expected human behaviour in every society and country. It would have been perfectly o.k. and "legal" about rsharma's statement if he would have already been US citizen at the time when he stated what he stated.

    Such ridiculous, unnatural, premature, unethical and spineless behaviour can only be shown by the people who are already morally sold.

    First of all when somebody comes here in USA on work visa, s/he has come on invitation from USA base legal employer's willingness and is ethically, legally and morally obligated to provide professional class and quality of work for what s/he is hired. Nothing more or less is legally expected by USA and employment system within USA. USA and its whole society is well aware that these persons are citizen of other countries and so they never expects any kind of fidelity from them at least "legally" and at the same time they even do not grant the rights what US citizen nornmally have. Now out of that bunch many people prefer to go for permanent residency as permanent residency bring little bit stability in living and flexibility in employment and international travel. If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense.There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. And I do not know about other countries but in India it is not considered "illegal" and/or "unpatriotic" to go in other country(Except Pakistan and Bangladesh) for legal work so coming to USA for legal work whether on work visa or becoming a permanent resident in USA while maintaining Indian citizenship simultaneously is not unpatriotic or illegal. Simultaneously USA's legal system allows an Indian to remain as citizen of India while residing in USA permanently for legal work.

    Now if somebody decides to become a US citizen, there is nothing wrong in that. I do not see anything wrong when rsharma states that "I have decided to become US citizen in future". But if he is mature and human enough then his fidelity at this moment should be towards India (Assuming he is a citizen of India currently) as he is a citizen of India at this moment. Showing this kind of behaviour perhaps may not be a outright unpatriotic in terms of "Indianness" but it certanily signals probable but strong disloyality towards India.

    And I do not think that USA citizens are that naive that they consider the people "not mingled" if citizen of other country do not call USA president a "My president" while holding the citizenship of other country.

    If calling US president a "My President" by non citizens would be the barometer of "mixing" / "mingling" then USA would not be today's USA. So please do not kid USA and us .

    Who's is kidding whom? I am educated enough to spot a hypocrite like you. It does not take education or the knowledge of law but some common sense to think about these things, which you don't have. Also, a hypocrital bully like you does not have any morality or ethics anyways. Look yourself in the mirror before you call names or judge somebody. I don't need a lecture from a person like you, especially on the law or the meaning of citizenship, which I am quite aware. So, just keep rambling about your useless crap.

    Folks, we need to stay hopeful. If you notice the date towards end is 9th august which would mean VB should have been released today which didn't happen. The release date for last few VB is also 9th. It doesn't take too much effort to copy an old bulletin and replace month with September and change some dates here and there with likely dates which would still look very authentic. Seems like someone hacked into this no name website for sadistic pleasure...someone who is not very pleased with significant EB2 movements in last 2 months.

    The formating is also off. All other pages have a professional look. Why would the webmaster of a professional firm not pay attention to this. This indeed looks like a cheap hacking trick done in a bit haste. I am quite positive that real september VB with Q's predictions coming true will come tomorrow :) So my suggestion is to relax and have a good night sleep. Next day truth will reveal itself

    Hello H1b Guy,

    I am sorry for the situation you are in. The employer should be punished. Let me ask you:

    1. do you have any email correspondance with the employer asking you pay for h1b fee?
    2. if you don't then pose him a question using office email something like "how much is still pending on my h1b fee that i owe you (replace you)". Address this to HR or Payroll or the boss it self. Wait for the reply, and then take copy of it for record purpose.
    3. if '2' does not work then wire tapping is way to go:

As per the law in New Jersy, one party should be notified and if you are recording you conversation, you are the one party and the other do not have to be notified. Are you using voip in the office? if so use wireshark to record the conversation. If not then there are devices available outside for cheap to do it.

    Thanks lazycis, I mean no disrespect to anyone, just that I find it very difficult to understand some of the ways we all respond towards the events we don't understand. We all simply blame it on God.

    And this is the oldest trick in the book of "religious folks". As soon as you question about the twisted belief like "God's protection over this land", some "protecter of God" will throw at you, "people who beleiev in God, will find him". The question is not whether the God exists or not, the question is,
    "God's protection over this land"? When we are all children of God, then why would God only protect "only this land". Why not protect other lands where other children of God lives. I think that "God's protection over this land" is a thought from a very inferior mind.

    And I find no difference between between "child of God" and "son of God". We are all Sons and Daughters of God, although different religions wants us to believe that their masiah is the "ONLY SON" or "ONLY MESSENGER" of God. And that just too much baloney.

    Just like you, I too believe in the existance of God, however, my version of God is not sitting on a lion or a monkey shaped human or tied to a cross or telling us to kill non-believers to go to haven with 72 virgins. I think thats just too pipsqueak depiction of God. I trust that the God is present everywhere but its not what have been described to us by any of the organized religions. And everytime someone throws out some text, like the one Richard Ketchum, I am complelled to voice that its a twisted thought process, which often emanates from the twisted belief system of some organized religion.

    Also, Jeffersion, Adams, Franklin and other founding fathers of this nation were all extremely learned because they were all knowledgedable enough to keep the "religion" out of government. Because they knew that most men cannot distinguish between right and wrong when it comes to God, and too often organized religion blinds us by asking us not to question anything.

    I think you are scared to think that your existance is merely by chance. Thats why, for the things that are too big for us to comprehend, we want to think that there must be a "hand of God", just like that goal scored by Maradona in the finals of the world cup soccor. You are scared to think that if this all happened by chance, then it could also get destroyed by chance, so you want to believe in God the way your religion tells you to believe that "your God is protecting you and this earth from the evil". But the religions do not tell its followers that religion is the actual evil because it describes God in the wrong way. That narration of Richard Ketchum is to further someone's twisted belief system. And that's why I have a problem with such narration, because I fear that iit will continues bleed into our successive generation, which will continue to be bonded to these twisted beliefs instead of thinking freely. Thats the risk I am concerned about.

"Religion", "God", "some event which you believe was done by God", because these are all different things, although, "protectors of religion" will tell you that they all mean the same, and their "religious book" is the ONLY word of God.     You cannot deny that the American nation was found by those who where seeking religious freedom. Also read biographies of G. Washington, A. Lincoln, J. Adams and other founding fathers.     I think once the application is pre-adjudicated...that's it!! I don't believe USCIS will spend anymore time and resources to these applications again...until a visa number is available from DOS and they apply the number to the pre-adjudicated application....my 2 cents! I agree with what you say BUT they may open the file again (to verify certain things and not just assign it a visa) once the visa number is available (I guess that is what you are trying to say) ..is that right ?
    BTW - I have not read the memo in detail ...it is a waste of time
    I guess the 64,000 dollar question is - how to find out if your case is pre-adjudicated ?
    in summary - it is a big big muddy and dirty mess ..no wonder the right word is that the system is broken and very less immediate hope for EB-India / China

    Can anyone with some indepth knowledge predict availability for EB3 Rest of world (Canada). Here is some of what I understand - although I know it may be wrong (some infor from Shusterman site)....

    - 300,000 applicants in BEC
    - assume 200,000 get through
    - assume 1/2 have a spouce and 1 child
    - therefore need 400,000 visa numbers (Shusterman had 300K here, I think they are wrong??? - pls check my math)
    - now most EB immigrants are from China & India (half?????) - restricted to 7% of the annual 140,000 EB visas annually
    - all* applicants up to first half of 2002 are "gone" - *except for ones in BEC = how many????????????
    - AND if rest of world is 200,000 people in line for 120,000 visas annually (140,000 - 7% China - 7% India)
    - now people in line go from 2001 - mid 2005 in BEC??????; but very few 2001 & 2002s left????
    - thus: rest of world with PD of March 2004 - should get visa availability within this fiscal year - e.g. by Oct 2007????

    In most critical situations a person can file a lawsuit in federal court and ask court to 1) compel USCIS to process your EAD within 1-2 days and 2) enjoin DHS from going after the employer if person continues working with expired EAD. Part 2 is available only if employer wants to participate in a lawsuit. Otherwise, file it yourself, it requires the same amount of time as filing for EAD.

    Contact a Taiwanese/Asian lawyer and ask him to help you. You can add him as a lawyer, and even if you are replacing your lawyer, and if asked, you can claim language barriers with the old lawyer.

    Firstly I am not from India where most of your guys come from. Instead from Taiwan 2 and half year ago. As travelled much between Asia countrys, no much time staying is US office although I based here. Yes, my English is poor and broken but this is not a fake story, make no sense for me.     You can't generalize. If your kids are smart they can get into better colleges like IITs etc. I think you are confusing the issue about adaptability with good future prospects.

    Wait a second. If you are not adaptable to the new environment, it becomes a rat race.If the situation is not conducive, your smartness aint gonna help. I think thats what the OP clearly meant. Its not easy for a kid who is in 8th grade in US to snugly fit into Indian System. Coming to the IIT's, Have you ever compared the total number of seats available in IIT's to the accepted numbers from IVY leagues and other big schools. In India, you have to be the best among the best to get into IIT's. You have to be best here and oh yeah.. You dont have to lose some of the smartness to reservations. But I agree with you that parents should let children pursue their own interests rather than thinking about him/her being a doc/eng.

    What is your point? Madhuri just said that when kids are 8-9 years old it is easier for them to adapt to the canadian system rather than the indian system. No one said that the indian system is not up to the standard.

    Having studied in every single indian board system, state, cbse and icse along with primary education the london board (o/a level), I have some experience with regards to adaptability-> It sucks. I have a abcd friend who moved from US to india while in the 6th grade and she regrets those two years of her life. If you have kids in school over here please think 3 times before u shuttle them back and forth.

    The information was very helpful for me and others as well.

    I think my education evaluation and MCA degree doesn't specifically state that my Master's degree was a three year degree course.

    I now have a letter from University stating that it was a three year degree course and we are going for a fresh education evaluation.

    I think the lessons learned here is to make sure that the degree and/or EE should clearly state the duration of course.

    Any other suggestion or past success is highly appreciated.

    Also, my RFE respond date is April 22, 2011 and not March 22nd as mentioned in my orginal post.
