It is possible, but what's the point? It will have later receipt date. It is better to file a lawsuit to force the USCIS to issue EAD. It will cost only $350 :)

Anybody wont be eligible. Canada has been fine tuning the immigration since 2002.
Now only people who have studied or worked in Canada on work permit are eligible.
family based is greatly restricted unlike US where around 80 is non-skill based.
That may be the unofficial version. Officially you can apply even you haven't worked or studied in Canada if you qualify as a skilled worker with a year of experience. You get extra points for having a job offer from a Canadian employer but not having one does not disqualify you automatically. I'm not talking about getting the GC. I'm just talking about the application process. Some kind of processing is needed even to reject an application and I do not think USCIS is capable of handling the increased traffic that switching to a point based system would result in.

While this question may sound redundant, I want to make an honest attempt to understand it. How does creating media awareness translate into making politicians understand the complicated issues suffered by legal immigrants? Further do they give any weightage to the fact that the stories are in the media and therefore they need attention?
I am biased towards the opinion that we might have already run enough media stories. I believe that the real fight now is to convince the politicians to do something about it. Propaganda and lobbying is the only thing that works with politicians in this country. And you have to choose a medium that politicians directly refer to. Meeting politicians and their representatives in person is most effective I believe. With due respect to your views, Pappu, can we discuss some of these questions?

Basically they want to prevent offshoring legally... meaning
if microsoft wants job done.. hire locally.. or bring people on direct H1 so they net the taxes. or do the job overseas.
If Infosys brings people - do not let them work in CIsco, microsoft or, HP... that way they put overseas company OUT OF Business
USA needs fruit pickers not hi tec, this can be outsourced..

If you have plans to travel...could you go to the local INS office and get the AP??.AP is very important too if you are traveling.
For most cases, this is NOT an issue as they are on H1/L1/H4/L2 status while filing for I-485. They can simply travel on H1/H4/L1/L2 visa.

It would be great to have premium processing for 485s instead now that visa nos are available. Now now ... i know thats wishful thinking but think about it-could save a lot of time and money over EAD/AP/FP renewals. But then again hurts their income stream thats why they wont do it :((
why would it hurt their income stream...when theyll charge u rpremium fees for fast 485 processing..it will be cash in teh bag in the first go rather than waiting over the years for EAD/AP renewals.

I have 3 yrs degree + 1 yr PG diploma.
But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.
Here is a list of accredited institutions that offer online MS degrees at reasonable tuition:
Best Buy Masters Computer Science & Information Technology | Ratings & Rankings | GetEducated.com (http://www.geteducated.com/online-college-ratings-and-rankings/best-buy-lists/best-buy-masters-computer-science-and-information-technology)
You can also consider getting a US bachelor's degree through online courses and credits-by-testing from one of these:

List of Programs Available at Charter Oak State College (http://www.charteroak.edu/Prospective/Programs)

All these credits may or may not be transferable to the school/degree that you choose to enrol in. But you would have to research and find a school that would let you use most of them. That way you can complete your degree much faster than the standard process.
Whatever you choose, make sure that the school is regionally-accredited by one of these organizations:

Please note that the Form I140 is no longer valid for porting purpose under section 106� of AC21 if the I140 was revoked due to the fact that you did not meet the minimum requirements for the labor certificate at the time of filing. Due to the fact that beneficiary of the For I140 was found to be �unqualified� at the time of filing you are not eligible for relied under section 106� of AC21.

I hope 180 days had passed after 140 approval. A little more detail on the case will be appreciated. Was it a case of substituted labor?
First try to figure out what the previous company has done.
Get the help of your attorney ASAP. Figure out if there is a way to undo the damage.
I am not very sure of the details, a person I used to know was forced to join his previous company because they threatened him in similar lines.
& please do keep us informed along the way. We may be able to be of assistance to you in some way or the other. Local IV chapters have access to local Congressmen etc.
If nothing works go kick the ass of the person who is responsible for your predicament. Interpret kick ass to more severe alternatives. Some companies are anyway taking advantage of people stuck in GC queue. On top of that if they harm us they need to pay a heavy price.

This is like the banana joke in an old tamil movie, it is over 157 days and the USCIS now wants to go by processing times which mention july 3rd processing date, which is still late, but then they will say it is just one day over your receipt date.
If I were planning to use my EAD now or in the near future I would just cough up $380 and apply for a fresh EAD instead of chasing USCIS.
If it works, then it is money well spent compared to running back and forth to USCIS offices, calling them daily and all the painful aggravation involved.
I will gladly spend 380 instead of risking the possiblity of picking up Diabetes or Blood pressure due to stress.
If I were planning to use my EAD now or in the near future I would just cough up $380 and apply for a fresh EAD instead of chasing USCIS.
If it works, then it is money well spent compared to running back and forth to USCIS offices, calling them daily and all the painful aggravation involved.

We could not even pool $10K for FOIA. For lobbying, one needs lots and lots of money in the range of 100K -200K. What can IV do? Can you explain what you mean by "something'? if all of us EB3's can pool 100K, then we can request IV to do "SOMETHING". Hope every one understands this.
How is anybody sure that by spending 5K or 10K, you will get what you are looking for? Just because somebody quoted 5K fee for such an information (which may be their standard response to such custom information extraction requests), it does not mean it can be readily found. If it were that easy, USCIS/DOS would be using it. The fact remains that PD related information does not exist other than in physical paper applications/files related with LC, I-140 and I-485. There is nothing on the system based on PD's. Don't we see it in guesswork used for advancing and retrogressing PD's. Note that for most immigration applcations PD's do not play any role. Only when at adjudication time, birth country is noted to be India/China, the officer has to check PD with respect to current cutoff dates. Systems are not designed for handling any processings based on PD's, so quick access to such information is not available - with a fee or without a fee

If my priority date is retrogressed at the time of processing my EAD and AP, will USCIS keep the EAD and AP on hold? Or will they process EAD and AP and hold the I485?
