    They are again using their scare tactics to influence congress to drop its support for HR 5882.

    Calling all EB3 guys, Eb2 IND guys with PD after Aug 06, and others with PD retrogressed, its in your sef-interest to call your members of congress to seek their support for this legislation, and to contribute to IV. There will be no relief for a while if this fails.

    IT TAKES A VILLAGE -- Chain Migration Puts Nearly Everybody In Line To Overwhelm U.S. Communities

    As soon as we take a single skilled immigrant from a developing nation, around 17 different families may be put in line to follow because of our reckless Chain Migration policies.

    Our immigration policies literally "take a village" every time a new Anchor Immigrant is admitted to this country.

    Fortunately, our immigration policies do have a few boundaries and delays that keep the whole village from entering our U.S. communities immediately. But every one of the members of those 17 families begins to consider future immigration to the U.S. as an entitlement. And because of that, millions don't wait for their turn, instead settling in the U.S. illegally to wait for the greencard that they believe is rightfully theirs.

    THE 'ANCHOR IMMIGRANT'
    Our U.S. population is exploding -- consigning more and more of us to heavily congested, heavily regulated lives -- because of high immigration numbers, which have snowballed because Congress insists on continuing Chain Migration.

    Because of Chain Migration, every immigrant we allow into the country because he/she brings a special skill, education or experience becomes an Anchor Immigrant.

    That is, if officials determine that an employer can't find an American to fill a job and allow the importation of a foreign worker, that worker becomes an anchor in the U.S. for vast numbers of other people from his/her home country.

    One problem for the United States is that only the Anchor Immigrant is supposed to be picked on the basis of serving the national interest.

    All the other immigrants attached to that Anchor through Chain Migration get to come without any regard whatsoever to their education, skill or humanitarian need.

    ONE ANCHOR CONNECTS TO 17 FAMILIES
    My "17-Family Chain-Migration Village" example is not close to the worst possible scenario but it is a nightmare that is not uncommon.

    Here's the scenario:

    Consider a typical Anchor Immigrant who comes from a developing nation and has three adult siblings. All of them come from one family. As soon as the Anchor Immigrant is accepted, all those siblings know that the Anchor Immigrant can put them in line for immigration once he/she becomes a U.S. citizen. Mentally, that one whole family is now in line to come to America.
    But there are many more families who mentally get in line, too. The Anchor's spouse, plus each of those three siblings' spouses will be eligible. That makes five families now in line (the original plus the families of the four spouses).
    In every one of those families are their own siblings, minor children, parents, etc. This is getting to be quite a crowd of people who suddenly see their future as possibly being in the U.S. That makes five families involved now (the original and the four spouses' families).
    Now, consider the siblings of those four spouses. That would be 3 siblings multiplied by the 4 spouses, equalling 12 more adults, all of whom potentially have their own spouses! Potentially, each of those 12 spouses of the siblings of the spouses of the Anchor's siblings is from a different family.
    Now, you have those 12 families, plus the Anchor's family, plus the families of the four spouses of the three siblings of the Anchor. That potentially adds up to 17 families that immediately can know that they are in a chain that eventually can have a chance to immigrate to America. And all of that happens the minute our government decides to give a permanent work permit to a single foreign worker.
    An Anchor Immigrant immediately creates chains of expectation into possibly 17 different families.

    You can imagine how a village or urban neighborhood can quickly have most of its residents seeing that their future is in the United States. Not only does this build huge pressures for more migration and more population growth in the U.S. but it saps whole villages and neighborhoods of the will for self-improvement.

    Why will people pour themselves into bettering their own communities when they believe their future lies living in America? And, of course, the chain migration does not end with those 17 families. Our rules are set up so that every Chain Immigrant also becomes an Anchor Immigrant, making it possible for every relative to get in line to come to the U.S.

    The only solution is to end the Chain Migration categories entirely. (See our pages on the legislative solutions.) That means limiting each Anchor Immigrant to bringing a spouse and minor children. No adult children, siblings or parents.

    The Anchor Immigrant can easily visit his/her relatives annually (or more often) and can be in constant communication by phone, internet and postal mail. Chain categories must be ended if we are to avoid the nightmare of 439 million U.S. population in 2050 as projected by the Census Bureau.

    CONGRESS THREATENING TO ADD 550,000 MORE 'ANCHOR IMMIGRANTS' NEXT YEAR

    Sen. Menendez of New Jersey is blocking the re-authorization of E-Verify (to keep illegal aliens out of jobs) until Congress agrees to add 550,000 additional Anchor Immigrants next year.

    At the moment, the leadership of both Senate and House are seriously considering trying to pass the 550,000 increase in Anchor Immigrants.

    Powerful media like the Los Angeles Times and New York Times are lobbying hard for more Anchor Immigrants.

    Unless the American people themselves become fully aware of the dangers of Chain Migration and the concept of the "17-Family Chain-Migration Village," the Big Business and Big Media lobbyists are likely to multiply the chain migration nightmare many times again.

    Make sure you have gone to your NumbersUSA Action Buffet and sent all your free faxes to push your Members of Congress to stop Sen. Menendez and to eliminate Chain Migration.
    Except the native Americans all are "Anchor Immigrants" who became citizens later. The guys in Number USA are also from the same family tree. So let us just do not pay attention to all these b***s*** and waste our time.

    Spouses and Dependents of Legal US Immigrants Should Be Granted Work Visas
    America is known to be the land of immigrants. Immigrants have been a part of American history. There is a lot of debate going on these days on the issue of illegal immigration in various social and political circles. But we also have a fairly large number of legal entrants in America who are officially documented residents. Spouses and dependents of many of these legal U.S. residents are not granted work visas, inherently. Instead they are issued H4 or dependent visas. H4 visa type allows dependents to stay in United States as long as their spouses are legally employed in any organization within the U.S., but they cannot obtain jobs as per the current labor laws. This is a sheer waste of talent for many who migrate to the land of opportunities with a desire to live the American dream. Not granting work permits to the spouses of H1-B work visa holders, makes them feel financially dependent and estranged. Many of these immigrant spouses are highly-qualified professionals with marketable skills but cannot obtain a job, by law, despite being in U.S. legally. By all fairness, dependent spouses should be granted work authorization for the sake of their social, economic and emotional well-being.
    According to the U.S Department of state, �The Immigration and Nationality Act provide several categories of nonimmigrant visas for a person who wishes to work temporarily in the United States. Some of these categories include H1-B (person in a specialty occupation), H2-A (temporary or seasonal agricultural workers), L (intra-company transferees), F-1 (students with demonstrated intent to return to home country upon completion of undertaken program) and Q-1 (participants in an international cultural exchange program) visas. With the exception of "Q-1 Cultural Exchange Visitors," a person who has received a visa as the spouse or child of a temporary worker may not accept employment, in the United States� ("Temporary Workers"). Dependents of non immigrant visa holders on H-4, F-2(spouses of student visa holders), and TD (spouses of citizens of Canada and Mexico), visas are directly affected by this law. According to a survey by NADISA (Network of Advocates of Dependent Spouses of America), �Most of these dependent spouses are immigrant women who do not have a penny to their name except by the grace of their husbands. These are some highly educated, well-experienced, motivated young women who are ready to support themselves, but cannot, by law, get a job despite being in the U.S. legally� (Shah).
    The inability to work in the U.S. on H-4 visa status creates a handicap for career minded women. It puts them at a disadvantage of losing several years of professional work experience. Mehreen Arshad, a graduate in commerce from Bangalore, India and an MBA degree holder from a top U.S. business school is one of the victims of this highly unfair labor law. She is on H-4 visa status for the past 8 years. She says, �This never-ending wait for getting work authorization has ruined my entire career. We are in process of getting Green Card (permanent residency status and work permit) for the past 8 years. Despite having an MBA from a U.S business school, I have been denied jobs several times because of my H4 status. Employers tend to prefer Green Card holders over dependent visa holders. Many organizations clearly state in their job ads that only citizens or green card holders can apply. This truly is a waste of talented workforce and expresses social inequality and discrimination towards legal immigrants.�
    With the rising costs of living, education and healthcare in America, not allowing the spouses of immigrants to work is practically like incapacitating them. Every member of the family needs to contribute to sustain financial stability. In a family where one person works and the rest are dependent on one source of income, it sometimes gets hard to make both the ends meet. Dependents of immigrant workers should be granted work visas or they atleast should be allowed to do temporary or seasonal jobs so that they can contribute towards family income to improve the standard of living.
    Dependent spouses often get the feeling of being financially controlled by their husbands. Since they are not the providers or bread winners for the family, dependent spouses are often kept out of the decision making process. They cannot make important decisions in life like buying property, starting a family or business because of the financial instability.
    In addition to the social and economic setbacks, spouses on H-4 often get the feeling of being alienated. Without work authorization, spouses feel that they are trapped in households and domestic life. Without getting a chance to work and ever being exposed to the local community, it becomes difficult for spouses to understand American culture and fit in well.
    Apart from obtaining work permits, dependent spouses are also not issued social security numbers and in many states they cannot even get a driver�s license. Due to all these restrictions, a lot of women on dependent spouse visa status become victims of abuse and domestic violence. �Without the ability to earn money independently from their abuser, battered dependent spouses are not financially secure to protest the abuse, leave the marriage if necessary, or even buy a ticket to return to their home country. Batterers use their financial control to keep victims submissive and often prevent them from staying in status or converting to another status. Without work authorization and the ability to determine their own futures once legally in our borders, many become vulnerable to domestic violence. Once victims, battered dependent spouses find they have no more protections than undocumented immigrants� (Shah).
    �In 2002, President Bush signed into law a bill which allows dependent spouses of L (intra-company transferees) and E-3 (citizens of Australia) work visa holders to obtain work authorization. No legislative reason is given for not extending this basic right to H-4 visa holders� (Shah). The current law prohibiting spouses to work on H4 status does not make sense to many because L and E work visas are exactly the same in nature as H-1B work visa, so it is hard to understand why spouses of H1-B work visa holders are still being restrained from obtaining jobs in United States?
    Anti-immigrants argue that there is a need to protect the U.S. labor market, so dependents of legal immigrants should not be allowed to work. But in case there is a demonstrated shortage of labor in any particular field of work and an individual meets the eligibility criteria, why should he or she be denied a job on the basis of visa status? There is a demonstrated shortage of workforce in professions like Teaching and Nursing in America. �In May 2005, the National Commission on Nursing Workforce for Long-Term Care released Act Now for Your Tomorrow report which found that there are nearly 100,000 vacant nursing positions in long-term care facilities on any given day�( Rosseter). According to National Education Association, �Not only are America's schools experiencing a shortage of teachers, the growth of ethnic and minority student enrollment is creating a critical need for minority teachers to provide positive role models for the students�("Great Teachers"). With the established need of workforce in teaching and nursing areas, dependent spouses meeting the eligibility criteria can be effectively employed in these professions.
    There is also a demonstrated shortage of skilled workers in Engineering and I.T related fields. Few days back Bill Gates, the chairman of Microsoft Corporation commented that there�s an insufficient amount of skilled people in the U.S. labor pool. "Gates argued that, "If the demand is there, why have the regulation at all?" In a statement, Mr. Gates was quoted as saying, "Anybody who's got good computer science training, they are not out there unemployed. We're just not seeing an available labor pool." He further added, "The whole idea of the H1B visa thing is, don't let too many smart people into the country". (Murthy) One way to get around this shortage of skilled workers could be granting work permits to the highly skilled I.T professionals who are already in the U.S. as the spouses of H-1B visa holders.
    In view of the above arguments it is imperative that these highly skilled legal immigrant spouses should be granted the right to work for their socio-economic welfare. Work authorization will not only provide financial independence to these women but will also give them the right to determine their own future in case they are trapped in abusive relationships. Also, these immigrant spouses can be prove to be incredibly resourceful in areas of work where there is already shortage of labor. This would indeed be a multifaceted beneficial pursuit, as not only it would support needs of the dependent spouses in terms of their financial well-being but at the end of the day, it is the national interest and economy enjoying the boost from further skilled input.

    Actually, the analysis of numbers and the "math" that you refer to was also done on the prediction threads. So it wasn't really all that useless.

    BTW, I am one of those others who are all over the prediction threads. I don't have a big problem with prediction threads. My PD is Dec 2004; so I do need some comic relief once in a while.

    You want some comic relief? About this one: a friend of mine (from England) applied at the same time as me. We both filed 485 in 08/2004 and our PD is 01/2002, meaning it is current since 09/01.
    We both did FP but he never did the physical (I did it in 05/2005).
    Guess what happened today? His wife (the dependent) just got her GC in the mail!!!! About his? No news!!! Anyway, I told him it was a complete aberration: how could a dependent get GC before the main applicant was approved?
    And how can you get approved when you haven't taken the physical (neither of them has done it yet)!!!
    What do you guys think of this?

    There will be no movement in May bulletin, but June bulletin will be Jan 1 2006 for EB2. I'm guessing this based on last 3 years, where there was no movement in May but had significant jump every June.

    Hi everyone.
    I was part of the San Jose rally .. where there were about 300 odd people.
    My neighbors had been to the immigration rally in Washington(flew from San Jose) and they said that there were about 1000 people there.

    I have been following the immigration issues for sometime .. and I'm not very convinced that such small numbers can make the difference.

    Silicon Valley has maybe a 100,000 Indian engineers or more. Add families .. and a much higher number. Add Chinese and European immigrants .. and you have all of Silicon valley :)

    We should hold a huge rally say in the campus of some company like Cisco .. or Google(who are immigrant friendly) on a work day .. say Friday lunch time .. and have everyone attend.

    Being in Cisco .. you can pretty much get all their employees to attend... which is substantial.
    Also have industry people talking in favor of better immigration policies.
    (we could hold it in some other company or a common area .. anything works)

    Unless we can have a substantial number of folks say 10,000 or more .. I don't honestly see too much of a point.
    Even if IV collects a few million dollars .. and lobbies .. it will never have the impact of 10000 people protesting.

    We need to see if we can have similar rallies ever month in major hubs like New York, Washington, Seattle, Houston.
    Unless we have s sustained campaign and we have the numbers .. I personally do not see things really changing.

    I see people being optimistic about 300 folks in San Jose rally and 1000 in Washington. But having been to the rally in San Jose I don't see how 3 times that number in Washington is going to cut it. (Read Logiclife's post ... but we still need the numbers !!)

    I'm not being a pessimist .. appreciate all the efforts that IV core undertakes .. but am totally unconvinced of major immigration changes. Looking at something like CIR being struck down .. after being on television for long and being debated .. I think we should get real.

    Sounds like a very good idea if you guys can pull it off. I am not sure what is the level of support among American colleagues in Silicon valley, but their presence in significant numbers would make the biggest impact on the observers. I am sure there are those who see the bad in keeping talent out, many times the lack of certain skills needed might end up causing the whole project to be outsourced.
    If that makes national news and you are right it would take about 10K or so for that to happen, then our cause is likely to get more visibility.

    They will retrogress all categories for India/China to 2001, so everyone will have to wait. Eventually people will fedup and leave the country (this solves half of their problem). For others they will keep issueing RFE for the next 5/10 years and enforcing stricter followup on AC-21 so people wont be able to leave their jobs and get promoted.

    So who will want to continue working at programmer in their mid50s. Imp question is will there be a job for such candidate...and so they will move back.

    Optimistic or Pessimistic ...any guess in this Guess the movement game is worthless.

    Renewal of License or a New one for H1 or H4 or related visa... is fully based on I797... this rule has been applied since last 3years.. who all arrived in PA before 2002 or so... are safe they get the license renewed for more than 5 years but who are after that gets only renewed as per the I797 expiry date.. the problem lies what our I797 gets delayed, we cant drive ... sit home ... does anyone have a work around or dealt with such situation

    Looks like you are also a candidate with three year bachelors degree and a namesake masters from US univ that you bought and which put you in EB2.
    Legit EB2 = GRE (good Score) + Toefl (good score) + Fulltime MS/MBA + Job in forture 500


    I am not sure what a job in "forture 500" means :) but there are tonns of people, with no US degree, working for "fortune" 100 companies like MS, GE etc .

    Further to that, many reputed US university, including many of the state schools, offer Part time Masters course which per you is not legit.

    As I said earlier, I challenge you -- say in black and white whether a part time or online MBA from a school like University of Massachusetts or University of Nebraska is legit or not.

    1. 3 year degree from India + initial application in EB3 that is later converted into eb2 by buying a masters from some shady roadside univ in the US.


    So you mean that US Accredition agencies grant accreditation to "shady roadside University" . Why don't you complain to the authorities ? Or are you scared that your lies will take you to court ?



    2. bachelors + 5 years experience from some software company in hyderabad, as most people from there have at least 10 years software exerience even if they graduated 4 years ago.


    Why don't you point to specific cases .



    I am sure you fall in one of the two later categories.

    I do not fall in either of thse categories but I know for sure that you have failed to get ANY education after wasting truckload of your parent's money in a Tier 3 university.
