For 140 approval it takes anywhere between 6 to 8 months. Last year, the wait time was less.This is normal and the wait time will keep on increasing. Because last year there was few number of labors approved but as the days pass by that number will keep on increasing. My friend with I140(NSC) applied date of June 2006 was approved last week. My first I140(TSC) applied on Feb 2006 was approved by August 2006 and my second I140(NSC) applied in Sep 2006 is pending till today.
And if you try to break the queue by premium processing then the chances of getting a dumb RFE( A no sense evidence to the case applied) is 99.99% because they want more time to process the case.

Yes. You are in status. Filing for I-485 provides you legal status. If you are without project for too long, transferring H1b might not be an option. But you can work on EAD. You will not be out of status.
Good luck with your job hunt.
Status should not be a problem, but double check with a lawyer. I'm wondering if you can squeeze a sponsorship for a trip home. Not very long ago, I found out that if a US employer terminates a H1, they need to pay the home country relocation costs.
You should find another job, sooner the better. But I sure would like to get such bad desi consultant companies to pay for a plane ticket.

Did your status change after submitting the affidavits?

All you need is Affidavits from you Father, Mother and any other close relative. Ask them to go to your local court house. There will be people sitting there who do prepare affidavits and notarize them. They need to do it on 10 Rupees stamp paper and get it notarized. They shall have the date of birth affidavit template at court house.
Once they have them, ask them to scan and send them to you to save time. Also ask them to DHL the originals so that you could recieve in 2 or 3days.

Iam curious to know if IV is supporting Hagel's bill which will not only increase H1Bs but also has good EB provisions.
It might not be a bad idea to have some interim relief instead of focussing on gigantic CIR .

A friend of mine who went to India's premier institution - IIT in India and then to IIM worked for one of the fortune 100 companies here in the US.
He got married and decided to move to UK because his equally qualified spouse being on a dependent Visa could not work due to the obsolete rules.
Both husband and wife are well on thier way to permanent residency in UK.
Doubly bad for the United States!!!

With the revision of the bulletin being revoked, things kind of worked out ok. However why has'nt anyone looked into what exactly happened on July 2nd and who was responsible for what? All the questions that Zoe Lofgren asked were very legitimate. Why were they not answered? We had Condi Rice say that all visa's were exhausted; this was on TV. Was she lying or mis-informed by someone in her department? Who misinformed her? What was the motivation for revising the bulletin? Who ordered the mass-processing of pending applicatons that we have now seen? Why were all dates made current in the first place? Which agency did it and who did they not talk to?
If it were not for the flower-campaign induced media exposure, and the tough stance taken by Zoe Lofgren, USCIS/DOS could have gotten away doing whatever they wanted. What if the next time something like this happens Zoe is not working on the immigration subcommittee in the House? No one else stood up against this mangling of the law. If you steal a car and two weeks later go put it back where you took it from, it does not change the fact that you stole the car and must be held responsible for it. Where is the responsibility for what happened on July 2nd?
Anyone contacted the Ombudsman to see if he is doing a special report on this July 2nd fiasco?

sent to USCIS Texas on June 29, received on JUly 2nd at 10:25 AM. no receipts and no checks cashed yet. the USCIS receipting notice Texas said that they have finished receipting July 2 appl. what happened to our appl then?
pls anyone who filed july 2 at texas and with the same info who got their cks cashed and receipts rec, kindly share here. tnx!

I filed my application on July27th. I completed my FP on Oct 10th but haven't receive any news on EAD. My online status is still "Case received and Pending". It is mentioned on the USCIS website that the USCIS needs to provide EAD within 90 days of the filing as mandated by law [8 CFR 247a.13(d)].

we must always have a current and valid AP even if we have no plans of travel.
Last year we were thinking that "1) I'm not planning on going anywhere after / atleast for a year.". Then one of our parents had an accident and we could not go, because there was no valid AP.
I guess, we can not take any chance on AP or EAD. Apply prior to the 120th day of expiry.

2) My wife's AP filed last year took Six months to get approved and what happens if you fly out while your AP is pending / sent for renewal. I read in this forum, not fly out, while you AP is pending.
