Track the status of this bill -
S. 2804: Employ America Act (GovTrack.us) (http://www.govtrack.us/congress/bill.xpd?bill=s111-2804)
We can read between the lines and be as optimistic as we want..but I do not see anything in the text that excludes EADs.
As per pappu's initial email, everyone - H1B, EAD, L1 etc etc (except GC holders and citizens) are impacted by this bill.
What is the guidance to IV members? Start contacting the senators in the senate committee that deliberating on it and impress upon them to oppose this draconian bill?

Hi,
Have a question on my visa.
I applied for H1 visa with company A, when I am in US in Apr'08 with
L1 thats getting expired, due to emergency I went to India.
I got h1 approval notice with COS on July'23 2008.
My Indian company B asked to get fresh L1 , so I took a stamping on
Aug'20 2008 and came to US on L1
changed company A with H1 visa . (company A did not do any COS again, since they say H1 is already with COS).
Want to know if my H1 is valid do I need to do any other things to
tell USCIS that I am on H1 NOW. Can I do stamping at Mexico/Cuba.
If there is any problem above how to come out of it.

i guess he is talking about your case a)...
although it might be his own opinion which could be wrong but seems from his forums he does tell you valid points time to time....
and he does post some useful data (remember the recent backlog data he posted before they officially released it).
anyway, why be so skeptical, don't we watch all the Superbowl ads but only buy the beer we like ;)

I think you are absolutely right. The only chance that legals have is through a CIR. I have been watching the trends for the last 3 years and everytime anyone wants to put anything for legals, it is shot down. It is not that house and senate can;t do it but it will be a political suicide. It really doesn't matter - you are democrat or republican. All Americans are afraid to lose jobs. They are concerned about immigrants taking away jobs. In my opinion, things will continue like this at least for next couple of years or so.

if you read previous discussion and particulary logiclife post, you will find, any immigration reform bill will not be discussed let alone passed until it resolves illegal immigration issue

my point is we don't need any legislative change at this point,
IV is for legals who are already here legally and our demands are very simple, such as if they allow use to file I485 with being current and if they use unused visa numbers and allocate them to over subscribed countries our life will be lot better,
we need to rethink our stratergy and stop knocking these law makers, who cares only about illegals, either they are against them or far them, but they just don't really care about legals

Call USCIS, there number should be listed on the receipt or online.
Ask them to open an SR as your cases has passed the normal processing time.
They will do that for you

just to let you know, even with PD current people have to wait 60-360 days for approval by service center.
You cannot imagine what will happen to processing efficiency at USCIS with additional work.

Lucky you, you might start seeing LUDs on you case by the end of this month. If you do please send me a message.
Reg correcting the dates, USCIS usually takes months to respond to such things. I'm not gonna do anything about it for my case, unless the processing dates show virtually no movement.
My understanding of process.date is that it is the oldest date of completed cases - which means they might be caught up with processing on most cases received till that date (July-20th 2007 ?) I could be wrong, we'll see..

If we don't raise our concerns at the moment, how can we let lawmakers understand our situations and our requests? The goal of this forum is to speak out our voice. This is a very good chance to unify all of us to speak out loudly. We shall not to care too much about the outcome of the lawsuit. As far as I understand, none of us knows better on immigration laws and litigations than these lawyers. If they has decided to do something, we shall concentrate ourselves on supporting them instead of questioning them. Meanwhile we shall urge the lawmakers to pass SKILL or at least to make a more stable and predictable process to practice the immigration law.
We shall let all the lawmakers who support the CIR understand how they can resolve problems practically for 12M without any legal documents in the USA if our problems on the process cannot be resolved. The basises for addressing 12M illegal immigrants are and only are to have an effective and efficient border control system AND an effective and efficient process to handle all the legal applicants.

I expect things to be more transparent from February onwards (note month of Feb), that is because i beleive that the new leadership will ensure that there is a transparency in the whole process rather than a lottery like approach to the dates.
Also i beleive the whole GC process will be more professional giving folks like us much much more respect than what the current approach is doing....
....and ....no world hunger , no drought any where in the world, no pollution , global warming reversed , people will love each other , no fighting any where for any reason..... :) :)

It is the same DXXX system. Same people processing your cases. Don't expect mirracles. You will be disappointed. We shall be lucky if those waiting in line now get their GCs by the time Mr O leaves office (4 or 8 years).
If you think I am cynical , so be it. Seen Clinton , saw bush and will see Mr O.
Nothing against Obama.
Also i beleive the whole GC process will be more professional giving folks like us much much more respect than what the current approach is doing....

Well said GCBY3000. Since something is going to happen, she wants to project herself as though she put in some effort. A few months back when I made a phone appointment with her, she was not at all helpfull. All she kept saying was, we can do it for you for so many $$$. It was all about money, money and money. I honestly doubt her intentions.

And why did the africans not rebel? Firstly because they sold other africans into slavery. Secondly no africans brought back news of the situation from america to africa.
Both these tricks are used on h1bs from india. Sadly, one of the major accomplices in this are Indian companies.

Except for myself and Rajeev, no one joined the conference call tonight. C'mmon guys, we need some action here. We all ought to participate in these calls. Writing emails, coming and posting I am in is not going to help. We have to take actions here. I will set up a conference call on another day next week and please make sure you all attend.

All if we do not participate actively in the state chapter activities we will only be hurting our chances for the bill next year. It is every easy to write long posts and several posts on the IV forum about ideas and thoughts but all this does not really help. What helps is the real work -- Meeting lawmakers. Forum is just a tool for us to communicate and share views. Pls all actively take part in chapter activities and attend the next conference call.
