This issue can be pushed if we have strong support for it.

Yet to worry about the namecheck. And for EB3 and EB2 post 2004 filers the burning issue is still country wide quota.

We all can certainly do one thing, we can write emails, letters to editors and media talking about our personal situations, highlighting EB visa backlog and how that is hurting legal-tax paying aliens like us. We can raise awareness in the media and we can bring new members.
When something is asked of us, we should do that. Pappu asked everyone to write to the editors thanking them for the story about immigrant entreprenuers. Just yesterday, we had some people come forward and write to all these editors.
Myself and some other members even posted names and emails of all the editors that we should thank in the "news article thread". If all of us can go there and write emails and flood them with thank-you notes, we will get noticed. Remember the print media business is based on how many readers they have, we have to make them feel that this issue is very important and is getting them more readers and membership.

In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.
AFAIK:
AC21 is not a law, just a guidance. Assume an immigration case goes to court hearing, the judge would completely ignore AC21 guidelines. Any employment per AC21 will be considered unlawful in this case. The probability of a case going to court is not very common though.

We had similar problem in 2004 .Actual mess was created by VFS .Check your online status,I think you can use your passport number to track your passport. In our case passport was transfer to different vfs office .after three days they return our passport to Mumbai consulate ,this hole process took us more than week to get passport in our hand.Dont get panic...

For all of you who have got standard responses from USCIS, please do something about it. Call the local senator, file DHS-7001 with CIS Ombudsman, send a letter to USCIS secretary Napolatino, call TSC using POJ method, etc, etc.
If you are current, they need to look at your file. Case under review means nothing at all....my case was under review since July 20, 2009. Finally, i found out that my file was sitting in the storage and collecting dust.
As other previous posters have mentioned, you should try calling TSC/NSC on Thursday/Friday evening. I found out that the IOs were in a better mood, as compared to my calls on other days (specially in the morning/afternoon).
If you need details on the IO I talked to, I can provide it to you offline. I am still trying to reach that IO (need to say a big thank you) but have been unable to talk to him/her so far.

This is good news..But the Damage is already been done..in the past.....
I guess DOL had some 300K cases pending when Backlog center started..It adjudicated some 150K till now.( Rough Estimate) and still 150 K left.
Even if considering 10000 Labors been substituted till now ...Imagine the wait period for rest of us. I wish this law was enacted, when they started Backlog centers..
Anyway..something is better than nothing....Hope for the Best...for new laws regarding SKIL,CIR Etc..atleast filing 485 when Visa numbers are not available..

My H1B going to expire Jan 2008. I am not planning to renew it. My PD is current (india-eb2 2004 jan). I am planning to travel in March 2008. Do I can travel with AP, without valid H1B papers. ? Do I need to renew my H1B ?

You should have AP approved to travel in / out of USA, and valid EAD to work after your H1B expires (though you continue to work for the same employer). It is recommended to keep H1 status as long as you can, just in case anything happens to AOS - Again, it is a personal choice to renew H1B. I dont forsee any exit/reentry problem due to not renewing H1B. Good luck!

it would make our plans to go back even more certian.. A MASS EXODUS of HIGH TECH WORKERS.. is exactly what this country needs..way to go!
If CIR S.1348 results as a death sentence to the draems of thousands of
hightech workers and eventually it results to a exodus i'm sure they will realize the mistake at the end.
When they will see that No one is interested in this country to study and Pursue STEM ( even with scholarship) and their problem is still unresolved they probably have to spend Double the Money to bringback Indians here.
