If I had my green card today, I would surely be making at least 15K more in my salary per annum repeat per annum.
If not all, many of you are in the similar situation.
My $200 contribution is just 1.33% of that lost opportunity per annum. If I take into consideration the 4 years of wait, it comes to 0.33%.
Almost anybody who is in US for 5 years on H1B can buy an nice little home. (Bay area is bit more cruel).
Last year I could have bought a home for say 500K. It would have surely appreciated by 50K. But because of the uncertainty of GC, I can not. That's a loss of opportunity of 50K.
My $200 contribution is just 0.4% of that another lost opportunity.
Now you know why I support this effort.
Most of you and your friends are in a situation similar as mine.
I urge you to become aware, make them aware and support this effort, which has a potential to minimize those lost financial opportunities, with your wallet.

There are 1000+ members on these forums. If everyone contributes 200$, we will have $200K. That way, the core volunteers can concentrate on getting the work done by working with QGA/lawmakers etc instead of worrying about our survival for the next month.
If we can get double this membership (each member gets one more member on board), our contributions per head can come down to just $100.
Then nviren's contributions as compared to his lost opportunities will get reduced by 50% ($200 to $100) ! So his contribution compared to the lost opportunity in terms of annual increase if he changes his job is now down from 0.33% to 0.17%.On the other hand, if we each get 5 more members, his contribution($200 to $40)/opportunity percentage is down to 0.065%....
What we can do as a group now is
a) Contribute our part
b) Get as many friends as we can to become members of IV.

On a second thought, though, why then DOL said that I required 5 when I had MS plus 5 yrs of exp.? Did they interpret my 5 as including the 4 yrs attributed to getting MS?
it is the experience after the MS that counts.
PS: Also, if someone takes 4 yrs to do MS when it should not (exceptions health-related gaps) take more than 2 to 2+1/2 yrs, red flags may arise.

Hi All,
My son was born last month and applied for US passport. Once I get the passport I am planning to apply for PIO card in Texas. Can you please let me know if I need to send my son's original passport and the processing time. Can you please also let me know if anyone recently applied?

Why don't you start a similar forum for "going back to India" ? I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.
The Indian economy is booming and the salaries are excellent. You just need to make some adjustments with quality of life (pollution, traffic). Atleast its better than going to Canada, living in limbo while looking for suitable jobs for a long-time, sometimes even doing odd jobs just to make ends meet. I hate our Indian mentality that "every place in the world is better than our own country". Give me a break guys.
My plan of action is very clear: Go back to India and live there happily. If there are other opportunities in US then come back.

With a few bills introduced or in the works, isn't it the time now to act and bring about awareness to our problems? I know IV has been working through state chapters. We can supplement those efforts with other means such as those suggested in this thread. We need to create an uproar about the hopeless situation and endless wait times due to retrogression, backlogs, and bureaucracy. I am not suggesting anything drastic. Just some peaceful ways that won't offend anybody to draw attention to the forgotten issues of EB immigrants.
I completely agree with you. However our problem is 'how do we organize a massive protest". IV is a loose affiliation of people affected by the immigration problems. They all realize the importance of fighting, however majority of them are unwilling to contribute personal time/money/energy for this cause. Flower campaign was first time in recent history, when legal immigrants showed some unity to express their anger and frustation.
It was predicted that once 485 is filed, people have EAD, and spouse working ... affected people will loose the apetite to carry on the fight. And that's what precisely took place. The biggest chellange is to let the affected people realize that if they do not come out and fight, no one will take care of their interest. It seems everyone is waiting for others to go out and fight, so that they can reap the benefits without any struggle. Now tell me my friend "how do we organize a massive protest??"

I agree with you, i think he is in deep s.... and the whole trying to type broken English thing is also fishy (in my opinion its on purpose)!
This guy has been in the country for more then 3 years (at least - based on his h1 being valid till 2011 which means recently extended)) on a work visa and cannot communicate a simple fact that they were fooling around and he didnt intend any harm (if that is the fact).... HE must be really really good at what he does at work for his company to keep him!
But to give the benefit of the doubt and innocent until proven guilty - I wish him luck!

This EAD thing is really annoying, my wife got her AP and EAD last 11/21, with immediate update in USCIS.gov. I'm still waiting for mine, and I'm the principal. Anyway. I'll have an infopass appointment on 12/18. My H1-B permit expires on 02/07/08.
We applied to NSC, all documents received on August 02/2007.
My RD at NSC was 07/02/07 and my EAD status changed to "production ordered" just 5 days back(still dont know when I will get it). I think NSC is taking upto 5 months from RD to process the EADs.

Well, I like you because you are just a straight shooter. If you are such a straight shooter then let me do some straight talk, so just catch this.
Your American mid-size company or Desi small size or super size company will get $180/hr but you will not get even $50/hr from the same client even when you go direct. So no matter how "highly-skilled" you think you are, your non-compete argument is not good enough for you not to be able directly market yourself, because there are gazillion other companies using BI, Cognos, BO, Informatica, Datastage and every similar crap. You can impress a few people by naming some technologies that maybe hot but they don't mean a &hit if you market them yourself. Here is why. A lot of people blame the lack of GC as a reason to be exploited. That is part of the problem. The other part of the problem is that most hiring managers in large companies get commission from these small, mid-size or large American, Desi or European consulting companies. That's why in most cases they always hire through one of these companies. They will not hire directly because the manager thinks you to be a stingy desi, and if he hires you directly the hiring manager will not see a dime, so why will he hire you directly? This is a big cycle of corruption and everybody is part of it including lawmakers who get contributions from lobbyist/representatives of these small, mid and large size companies. You think lawmakers don't know what is going on? You think client doesn't know that you make 85K when the middle company get $180/hr? You think the big-bosses at the company/client doesn't know that the hiring managers are getting favors from middle companies? You think lawmakers doesn't know that immigrant worker waiting for long delayed GC is bonded to an employer that buys employee retention insurance policy for the employer? They all know it. But you see every player in this movie, you, your hiring boss at the client site, the middle company, the lobbyist, the lawmaker and many more, they are all being paid from that $180/hr which you think that you are entitled for because you know Oracle BI and Congnos. Yes GC/EAD gives to room to look around / negotiate the higher rate , to sustain and move up will require a lot more than that.
Look at the aveage compansation for any area.
Assess your expertise ( not to compare with you the guy sitting next to you)
Try to move up in the ladder
Keep updating your tech skill
Diversify to more ( but related ) skill.
Add niche like PMP / Six Sigma.
Top of all , little bit of Luck , to be right place at the right time .

Nope ur PD has to be current for them to process your AOS and Aug is already unavialable so there is no way they will process ur paperwork. Also I think within 60 days of AOS you can add spouse. You should talk to a lawyer and not use other people's judgement to decide to file or not to file. But, will there be a scenario where my AOS gets approved before my PD is current AGAIN? That is what I am afraid of.

We booked a brand new house recently...after switching from consulting job to permanent job..I am on EAD
GC wait is endless ...kids are growing and don't want to raise them in rented apartments....paid 5% downpayment to have minimum risk...we procured couple of properties in India from our previous savings to fall back in case any unwanted situation in US

Another person I know; he had H-1b and was working for some motels (he specifically told me he did IT work and wasn't working as a clerk and the company was a holding company with many motels). His case was transferred to local office. Local office called him and stated they wanted him to come to office next day. When he went they asked him why he was listed as an account signatory on the motels bank account. They thought he wasn't doing h-1b work and was doing unauthorized work.
My employer has made me an account signatory in one of his other company(a sister company of my H1company), so i can take the money out for travel expenses. Is that going to create any problem? I have my regular pay check coming from my H1 company.

There is nothing in the USCIS memos to suggest that USCIS has implemented any such policy. CR you talked to may be ignorant and giving wrong info. Or it may be deliberate to reduce the number of (repeat) calls.
I would suggest recording the conversation with CRs so that we have proof of this conversation. Don't forget to ask his/her name and id number while doing this.

The customer service representative told me to take an info appointment further to get the Interim EAD. I have explained him that local offices are not giving Interim EADs and surprisingly he told me the following thing.
"You can continue the work with I765 receipt notice provided your employer is OK to continue and told me to provide the receipt notice to the employer as a proof of your application is in pending. As I am surely aware of the fact that in order to continue the work we must have an approved physical EAD. I was totally surprised and asked him "Are you sure?? can we continue the work with the receipt??", he replied "Yes and only if your employer agrees for that!"
I have no clue???? What to do, friends please share your thoughts on this.
