    If LOA can stop the old employer from revoking I-140, I would say, go for it. But just make sure you don't land into any other trouble (like non-competent etc. just an example, may not be relevant in your case, but you get the idea...).
    Also, discuss with the new employer and make sure they are ok with supporting you in case of an RFE. From your response, looks like they might know what it is. What I can think of is, consult an attorney and discuss what kinda RFEs you can get that needs employer help (mostly EVL, ability to pay), prepare a sample response letter for both and check with the new employer they are ok with providing them if necessary.

    the new company has no clue about visa/h1/gc issues. they have never hired a "brown" guy and they do not even know that i am on ead..even if i told them they wouldn't know wht to make of it..so the only letters i can get will be generic letters stating my occupation and salary with a very brief description of duties. i know someone said loa is not a good idea but i think it just gives me a back up.

    There has been established a way to deal with backlogs at Dallas and Philly, and these officials at PBEC and DBEC have been given a deadline of Sept 2007 to clear everything. So someting is and will be done in this regard. Not much more can be done here with PBEC or DBEC, and the real test is to get solutions for the retrogression.
    Once the laws are passed on the immigration reforms, its a done deal my friend, and then it does not matter how much we try after this to address retrogression. This is our only chance.
    BUT realize that there have been delays in PBEC and DBEC only because of lack of resources, which can be added or taken off...and this will speed up or slow down DBEC or PBEC. This can be controlled outside legislation.
    BUT THAT IS NOT THE CASE WITH RETROGRESSION. NO VISA NUMBERS = NO PROGRESS TOWARDS FINAL GREEN CARD. DONE DEAL.

    SO PLEASE FIGHT FOR RETROGRESSION AND DO NOT LOSE FOCUS BY FOCUSSING ON PBEC AND DBEC. PBEC AND DBEC IS JUST A RESOURCE ISSUE AND NOT A NUMBERS AVAILABILITY ISSUE. LETS NOT LOSE THE WAR TRYING TO WIN A SMALL BATTLE.


    Please shut your mouth. You do not know and feel what we are going thru (PBEC victim). As a member of this community, and have contibuted monetary support, I too, would like to have the problem in PBEC be heard.

    This is not 100% relevant to this thread but since we are discussing APs here, I thought I will ask the question.

    Do we need AP to go to / come back from US Virgin Islands? I know that these islands are U.S. territories and should be nothing more than going from one U.S. state to another. The reason for my question is that the DOS website states that for travelling to USVI, the U.S. citizens should carry a Photo Id AND Birth Certificate to establish the U.S. citizenship. Many websites state the same thing and some sites mention that this is because of nearby British Virgin Islands. As you can just take a ferry and come from British islands to U.S. Islands, the Immigration authorities on Mainland need to check your immigration status. This is not the case for travel to Hawaii or Puerto Rico.

    Does anyone know for sure or have personal experience visitng the USVI?

    It's just bad luck to get that kind of CBP officer. It's upto you to ignore this or escalate it. In my opinion behaviour of CBP officer was wrong.

    That IO must be a knucklehead who just hates "Specific type of people" or someone who does know the f** he is doing. I have entered using AP at Boston. San fran, Seattle and never had problems. Only once they asked me for EAD/a valid H1 petition and that was just a question.

    My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.
    Any body in the same boat? What shall I do?

    Lets see how much of this bill actually makes it out. As far as I can see, I am prefectly fine with refiling my application under this new category. The hell with EB based green cards.

    it depends on the individual hospital... your downside is only your wife getting fired... which might not really happen unless your wife supplies 100 A grade nurses to the directly competing hospital across the street... if she does that, anyway she wont care for the job.... :-) all the best... let us know how it goes...

    Thanks chi_shark for your reply. We are currently going through all her signed contract documents just to make sure we don't get any problem in future because now a dayz getting a residency is like getting Green card.

    I personally think that 6 month rule-of-thumb is nonsense.

    AC21 clearly states you can switch employers 6 months after your green card application has been pending. On what legal basis could USCIS then come back and deny citizenship to anyone for switching employers too soon after getting their green card?

    I'd really be interested to hear if someone has specific knowledge of a case where someone had their citizenship denied due to switching companies too soon after getting their green card.

    I agree with jonty and nixtor...that was the point I put out as a counter during our discussion. But the underlying sense is similar to what is there for illegal immigration: border fence. Humanitarian grounds is not an excuse you could use it with Congress men and women. Revamping Maths and Science in US schools is the exact justification against highskilled_immigration. Just like the border fence for illegal immigration, I wonder the issue in waiting against our efforts for fixing retrogression of highskilled immigration would be 'Show US born could start their training and educaction first' ...
    Again, my visa number too is retrogressed too and I am not doing a kaka here to throw water on flames of enthusiasm but reporting my followup with some loud-noise-makers in DC.. The posting was infact to show what we are against and how much we all need to do.



    Training and educating who doesnt have the background takes yrs. Businesses cannot afford to wait that long time. I feel that Jim Austin didnt address your question but asked you another question. Maths and Science are the 2 subjects US citizens need to pick up right from school. There is nothing much any one can do to change it night over night.

    What kind of charges may be filed under the following points?

    1. Processing and approving 60K I-485's in 2-weeks (12 times normal speed) just to avoid the flood of applications in July, when you consider that their typical speed is around 10K/month. 25K applications were approved in just 2-days (37.5 times normal speed) over the last weekend.

    2. USCIS requested visa numbers for cases where FBI background check was not completed. In other words, they requested numbers before processing could be completed for those cases and I-485s could be approved. Serious issue of lapse of national security here.

    3. USCIS apparently approved I-485's of some people whose dates were not even current in June, even if their FBI check had been completed and I-485 otherwise ready for approval.

    4. USCIS apparently approved I-485's of some people in July after DOS published the updated visa buletin on July 2nd advising that all visa numbers were exhausted for FY 2007.

    Any other points, and possible charges in the lawsuit using those points?

    Doris Meissner, director of the Immigration and Naturalization Service under President Bill Clinton, said the point system is being proposed with inadequate analysis. "I was amazed when I saw it because it hasn't really been talked about," she said. "There's been no ground laid for this whatsoever. Point systems are known in other countries, and there is certainly a body of written material on it, but it hasn't had any careful research.

    "It may be a good idea," she added, "but there isn't any evidence to argue one way or the other."
