Folks - Our strength in numbers is going to matter in the end. 40 people calling the representatives is not going to cut it. We need all the registered members to come forward at this time and make these ever important calls. The whole process does not take more than 10 minutes. People in these offices are really nice and easy to talk to. They will note down your message and pass it on to the representatives. Most of them are not even asking for your name or phone number or address.
For all those who are content with EAD's or not content with EAD's, ffor all those who want to switch jobs or careers and can't, for all those who want to get GC's sooner than later, each one of us needs to stand up for himself/herself because if you don't, no one else will.
Please pick up the phones and let your voices be heard!

There was a topic where googler had explained that as per DHS employee, unused Eb2 Worldwide goes to Over subscribed Eb2, so Eb2 India and Eb2 China.
It appears that the policy was always this, but since there were no excess Eb1 in the last couple of years, there was no spillovers in the last 2 years, howeever this year there are higher number of unused EB1.
In fact the way it appears is :
EB4 unused ==> spills over to ==> EB1
EB5 unused ==> spills over to ==> EB1
EB1 unused ==> spills over to ==> EB2 world wide.
EB2 Worldwide unused ==> spills over to EB retrogressed.
So before any spill over to EB3, visas are given to EB2 category.
Since the unused EB2 visas are given to retrogressed countries, I believe that more visas are used by country that has more retrogression. But if there is any future movement in EB2, than both India and China could experience it.
From www.immigration-information.com forums, it appears that one of the important driving force behind the visa usage is the actual adjudication of cases from USCIS. Since generally USCIS does not really process enough cases to use all visa's(to ensure they are not wasted), every year there will be a need to have substantial movement in the cut off date to generate more demands for visa's, not just in AOS, but also CP.

We advice not to use this template and form. The message and the organization sending it for their advocacy agenda is very important. Even if you change the wording, people will hardly read the letter. They will look at the organization that sent it and its agenda.

Hi Guys,
Considering that we have all spent enough time stuck in the same job for several years it makes sense to prepare for the time if/when we actually get green card.
So I was wondering if anyone here has weighed and compared the cost and benefit of PMP vs MBA. Any thoughts would be helpful.

With MBA from a good school you can start at serious management level.
It doesn't have to be vs, you can do both.

If I-485 is already pending with old EB-3 india I-140, then no need to apply new I485.
IF I485 was not field for some reason due to delays in backlog processing or PERM audits, then one needs to apply for new I485 alongwith new approved I-140.

Theres an enforcement only bill that increases the h1 cap to 130000. Ofcourse enforcement doesnt include making sure the EB quota is used every year - not that enforcement.

If someone has experience with working on the software they use for this site, they should volunteer their services. Dont we have a single 'Skilled' immigrant who can help implement those suggestions. This would be a great non cash contribution.

I like your response, really -- I think it's frank and hits upon what it means to be Indian at heart.
BUT, when one makes a decision to immigrate - he/she's not just making that decision for himself - but also for his/her spawns and the future generations to come. Is it fair for us to rob them of (well, i know most american born desi kids don't care a rats ass about going/being in India) - what it feels to be an Indian at Heart? what it 'Really' feels like to be watching/talking cricket/movies on 'em gullies, what it's like to be eating gaadi chaat, what a festival should really feel/look like .. and a bunch of other stuff- -that happens only in India.
not trying to discount anyone's opinions .. it's just the internal dilemma that needs addressing

Re - the original post - i dont agree that becoming a US citizen is an achievement - a test of your patience and diligence in going through the onerous process - yes, achievement - no. getting a US citizenship in no way makes anyone a better human being or a more accomplished professional - so not an achievement.
in about 4 years or so - i would be at a decision point of whether to take US Citizenship or not......i dont think I am mentally ready to relinquish my Indian passport....to me it represents a 5,000 year old civilization with rich history and heritage and yet in many ways a young country poised to take the leap into its rightful place among the community of nations.....if it works out i would like to go back and be a part of that leap but even if i am here..when that happens - i would want to be able to proudly wear my Indian identity (and if I am a US citizen and still try to wear the Indian national identity - it would make me a hypocrite!).......
Some food for thought - Laxmi Mittal and Amartya Sen carry Indian Passports!

I know that with a deluge of applications, the question I am asking might not be relevent in the current scenario (July filers), but what is the historical EAD processing time? I know they say that USCIS will issue one within 90 days, but does it always take 90 days or is lot lesser?
I remember when I got EAD during OPT, it took like 30-40 days on average. Does the same hold for the EAD for EB too?

There is also a 7 percent cap for each country. The sum of family and employment visas for china and india cannot exceed 25,000 approx as long as ROW is oversubscribed.
IF excess visa from EB2 ROW overflows to to EB2 china/india, this would clearly violate the 7 percent limit as the sum total consumption of visas by these countries would be well over the 7 percent of employment visas. Unless the overall demand for employment visas is less than what is available, the 7 percent would clearly apply.
The only thing that I feel might happen would be any unused EB1 china/india visas flowing down to EB2 china/india.

Personally, I wouldn't consider it obligatory to answer a specific question by someone who cannot volunteer due to "Personal Reason", whatever that may mean. If you cannot volunteer, cannot participate in IV's action items, cannot contribute, then you are most welcome to use IV's portal to get answers to your questions or get other kind of information - but do not expect updates from anyone as your right!
IV is not a top-down organization and if you think that it is becoming like Immigration Portal then partially it is due to people like you who do not want to participate but just want 'updates'.
I completely disagree with your message here. You dont even know what the personal reason for not participating in a state chapter is. I, for one, am unable to join a state chapter, because , the nearest chapter is 400 miles and 2 states away. What good would it do to me to join something that I can never be part of. I wanted to start a state chapter here in my place, but I couldnt find any useful resources on how to do it. May be eb3_nepa has some reasons like it.

The Admin Fixes letter campaign was a good initiative. But, the target date got moved twice, and now I dont even know when the end date is.
May be IV should be a top-down organization. Any organization as big as IV would probably be better served with a Top Team. That team could probably elected by the community. I am confident, that most of our members wouldnt even mind spending a few extra bucks to pay a honarary amount to this team for their efforts and time. Then there will be more structure and accountability and action going on around here.
I came to know about IV pretty late. When I did learn about IV and joined IV, I was a very enthusiastic participant. Of late, I do believe IV is fading away. I dont see so many activities going on around here. Like eb3_nepa and few others said, IV is right now becoming just another Immigration portal. It is starting to lose its identity.
After doing all the hard work to gather a mass or like minded people, it will be shameful, if IV drifts away from its stated aim. So, may be it is time for every member, including core members like you to refect upon things and come up with ways to make this organization more transparent and more accessible for people like me.

This membership group will have only members whose identities have been verified. Once this group is created, IV can post all the happenings accessible to them. Situation can be worse once we head towards election season. Still we have 1-2 months to get things done or we will be waiting for years to get green card OR EAD ( For some folks ).
