Employment Letter is Required. I would even go to the extent of emphasising to put original letter instead of a photocopy. Do not take chances. The application can be rejected/RFE can be issued in the absece of initial evidence. Read the new memo and educate yourself rather then blindly believing members or lawyers. Ignorance of law is not an excuse if you were to challenge a denial notice. When all information is available, make yourself educated. and BTW get a good lawyer to file your application so that each and every small detail can be taken care of.

Your criticism of Murthy is noted as you are entitled to speak your mind. But let me ask you a simple question:

Did you exhort your lawyer to send a letter to Secretary Chertoff or the USCIS Director? OR

Did your lawyer send a letter on his own, exhorting the Secretary and the USCIS Director to correct this wrong?

I know the Mahatma would have asked himself the same questions before hurling allegations.

Whatever maybe the intentions of Murthy, this letter is certainly going to help not harm our case.

AND YES - For full disclosure, I am a client of Murthy and have been so for more than five years.

Anybody has numbers for No. of EB Visas processed for June ad July 08. Till May 08 total 113475 has been processed. So, total remaining would be 50000.
Aug. 08 somewehere 6000 were processed.

you are making very sensible points. lets not trash her work.Agreed her firm sucks with beurocracy and penny pinching ( they asked my friend to send $25 whe he requsted them to send the fex -ex next night service for his LC approval when they had charged him $ 3000 for expedited filing of his H1B case, which they took 3.5 weeks to file). Some of her lawyers do hide behind their paralegals but most of the law firms aren't any different. So please do not blame her for that. She is a good lawyer.

One thing that i noticed though that she was rallying her clients to file 485 after july 2nd so that they can take part in the law suit. Once she was done billing her clients and the client checks cleared, she posted that she does not want to join the lawsuit as it will lead to increased scrutiny of her cleints. Go figure...

Okay. Even if we send the AC21 letter to USCIS, whats the guarantee that they will take action or even read it. AC21 letter is not going to be a paid service and USCIS will treat this letter as any other letter like interfile letters. I am not sure whether USCIS has any specific PO Box for AC21 services. In my knowledge, there is none. I had sent my interfiling letter in early Oct 07 and there is no information from USCIS on this. Today, I went to meet an IO thru Infopass, the first layer of service lady was so rude that she did not even allow me to meet the actual IO. She said that this kind of information does not come on computer so IO would not be helpful. She was not at all listening to me. My point is can one make sure that his/her AC21 letter has been accepted and acted upon. If not, is there any need to send the AC21 letter?

The 1st quarter ends Dec 31. So technically, USCIS has until that to allocate the total of 35,000 visas. Now, let's assume they have only approved 5000 visas across all categories thus far, then that doesn't mean they can go and allocate the remaining 30,000 in December to the retrogressed countries.

I think the way the spillover works (except for the last month of last quarter) is at the end of the quarter (technically Jan bulletin is published around Dec 15) based on the demand for the last 2 weeks for that quarter, USCIS will spillover visas. So I think we should wait until the Jan bulletin that comes out in December before we push for a lawsuit. If you want to send letters to people, then so be it, but I am pretty sure USCIS is well within its operating procedure wrt spillover. If spillover doesn't happen in the Jan bulletin, then we have ground for a strong case.

I guess we will be fine if they are not able to complete the spillover within the calandar quarter and issue them the month after (except when it is end of fiscal year). I hope you are right that the spillover happens in January for the 1st quarter.

But look at previous visa bulletins. Do you see major movements 4 times a year. Its always the end of the year. So we are asking for clarification on following the law which seems to say that spillover need to happen during the remainder of the calander quarter.

(5) 2/ RULES FOR EMPLOYMENT-BASED IMMIGRANTS
(A) EMPLOYMENT-BASED IMMIGRANTS NOT SUBJECT TO PER COUNTRY LIMITATION IF ADDITIONAL VISAS AVAILABLE- If the total number of visas available under paragraph (1), (2), (3), (4), or (5) of section 203(b) for a calendar quarter exceeds the number of qualified immigrants who may otherwise be issued such visas, the visas made available under that paragraph shall be issued without regard to the numerical limitation under paragraph (2) of this subsection during the remainder of the calendar quarter.

He doesn't compare with Mccain on any of the issues except being able to talk. He spends more money running negative ads than Mccain. Then he says, john, 100% of your ads are negative where as only 50% of mine are negative. Which is true but if you dig further Mccain is spending 1bout 50Mil on negative ads where as Obama is spending 80Mil. Though he is correct in his percentages statement,is he really correct?

Any time any question is raised , call them slimy is another strategy of Obama. He did it with Clintons and he is doing with Mccain.

Give me an ad like "he is palling around with ...". Or "he is teaching sex for babies..." or..
I can go on. Obama has highlighted healthcare policy differences. That is not negative ad. The only negative ad I have seen is " he is erratic.."
