Don't bet on this too much. Not being pessimistic, but in a democracy it is not just what is done but who does it and how it is done. Why should Republicans in the outgoing Congress vote again on a bill when their majority status is obsolete now? Do you think democrats will allow this outgoing congress to take the credit? they are politicians too, anything crappy in that bill is going to be the new Congress's (read Democrat's) burden. Already, a bombshell is waiting in the form of a hastily passed by the house_hastily signed by teh President bill: there is a fine print that removes oversight of how money is spent in Iraq (at least some of it). So, there may even be review of hastily passed, pre-election bills. anything more like this is going to give this congress very very bad name and the next congress a really bad headache.

USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... It is not fair but it is not exactly illegal...The law is open to interpretation and USCIS has chose to select this interpretation......You can take a crack at suing the USCIS.....I doubt that you would get anywhere......The EB2 India/China might benefit from the lawsuit....But as you know not all members would agree on IV spending resources on this lawsuit because this serves only a small section of member population.... At a personal level you can gather a few EB2 China India guys and have a crack at suing USCIS....
It says "not required by other classes". In this case it is required but could not be applied to EB2 due to per country numerical limits. Therefore it should go to unused pool of visas followed by AC21. Also why will USCIS prefer EB3 instead of EB2 people? It does not make sense.
As far as suing the govt is concerned we all know what happened to doctors in the UK.. so this is will be a futile exercise.

One step closer.
With last year crisscrossing, EB2 India most apps are cleared upto september 2004. We should not have too many in 2004 except substitution cases.
Hope it will step into 2005 in next 4 months....
Yes, I guess the slowdown will happen when it hits the 2005 mark when PERM was introducted and a lot of EB3 were converted into EB2

I quite do not get what you are asking. You want to know if buying a call on an ETF that has had a drawdown with an expiration of less than 15 days will be profitable?
There are various option strategies and I usually trade spreads as the most basic strategy. I rarely if ever buy just calls that too with such low theta (<15 days). I usually trade 4 legged spreads like the butterfly, iron condor or at least bull/bear calls/puts.
Most of the time I am long vol (vega) with a strip strap or straddle. Sometimes I am short vega but hedge it with an exotic like a digital, or binary on the vix. I always go for optimal delta hedge and often construct synthetics. Never plain vanilla calls and puts unless I am hedging something else in a different universe with an option.
If you can explain better what your strategy is I can make comments. If possible clearly state the greeks on the strategy so I can visualize it.

I too have received an update from CRIS about reopening my old H1B from my previous employer which is a large multi-national organization. I have changed the company since then and I have already received my EAD with the new company. I am a bit worried about the outcome of this review. If in the event of revoking the H1b of my previous employer, will my current H1B will also be revoked or am I safe irrespective of the outcome. Would really appreciate if someone can provide any feedback.

True, but you are forgetting the basic definition of demand. Demand is willingness to buy supported by ability to buy. If you are from any metros in India, think how many of your Non-IT, mainstream friends draw more than Rs. 50,000 per month? How can someone making even Rs. 50,000 a month afford 50 Lakh flat?
If there are 10 people drooling out side Ferrari showroom that does not mean there is demand for 10 Ferrari :)

I-485 is mostly about the eligibility of the individual (like medical, illegal presence, fraud etc.) and so getting rejected at I-485 stage is not that common (especially after the approval of the underlying immigration petition). And if it does get rejected, more often than not, the individual may never be eligible for permanent residence due to the same reason. So usefulness of H1-B as back-up is of very limited narure.

Just a note( i am not trying to deter anybody or argue against your compilation) that by law all foreigners are required to carry their passport, how many of us follow that, on that note, I will not carry original with me at all. just my 0.02 cents.

But I would think that passports, unlike the PR card, are not designed to be tucked into your wallet for carrying around. I have visitor insurance for my mother who is visiting us. Recently she developed some symptoms. The insurance company told us that since the symptoms were due to a condition that originated while she was in India, it is a pre-existing condition.
My advice to you all is to get a physical checkup for your elderly parents in India once in a while. At least you would know if there are any issues which come with old age and you can take an insurance covering those existing conditions.

You know, there are often times we all get upset that some stupid questions make it to the list, republican debate was one such yesterday, today's democratic one looked better. I hated that they did not ask our question inspite of it being the 2nd popular one but I personally think the question was too damn narrow for them to care.
For us, it may seem the world but for them it is just a technicality/one of the several points of CIR. Both Clinton and Obama seem to always chime in and act all gung-ho about legal immigration coming first.
Whenever they are asked about any frig'n immigration question, they throw the buzz word 'comprehensive immigration reform' and that folks, covers the entire gamut. The worst part is, on this issue the entire front runners look the same, well, almost. Mitt R is against but John, Hillary and Barack all seem to sing the same koom-ba-yaa song about CIR.

in year 2007 EB-3 india got 17,000 green cards, still not enough to take care of the high demand. there are just too many people waiting, that's the fact and nobody can do anything about it...except for supporting IV for these three bills...
