My advice to most people who do not perfectly fit into eb2 is to do the eb3 petition first (which is guaranteed to be approved). Get your place in line for the greencard.
If it is taking too long then you can try an eb2 later; if it gets approved then you will get the old priority date. If it doesn't; well you can say you tried but you didn't lost your place in line for the greencard because you still have the old eb3 in place.
However, if your cases is not clear for eb2 and you try this first and it gets denied then you will lose valuable time in line for the greencard because you have to start from the beginning.
Since, last august DOL has become weird with even approving eb3 labors. Generally, attornies will put language in the eta 9089 that they will accept three years of experience for each year of bachelors degree missing (this is in line with education evaluators and uscis).
However, this isn't the same criteria DOL uses. They will state that if a person doesn't have a degree then you are willing to accept 12 years of experience which is excessive and they deny the labor (before they were giving hard time to eb2 but not it is eb3 that they are after). So now we have an issue that DOL criteria is different then uscis critera. You use dol criteria, labor gets approved but 140 gets denied. Use uscis criteria and labor gets denied. Now, everyone has to adjust and file eb3 labors as skilled workers and only require two years of experience (it's getting more and more messy)

ya that explains.... so u'r some 20 yr old who need to grow up..... have to learn that sometimes there is a lot more to what just what you know......
and why would you prefer maths.... dummy, didn't you know, we have calculators & computers to do simple and complex calculations.....
btw, for starters, what've you achieved? if the answer is nothing.... then learn to appreciate others.... maybe that might help to be humbled at the effort and genius of 10 yr old.....

Recently I returned after a one month trip to India. At DC airport the CBP secondary inspection officer grilled us rough. First he called my wife and asked why did we leave US. She told that since my parents are old and not in good health we visited them. Then he started asking for documents proving it. And told us that without documents he won't let us enter. He went on to say that AP is only on humanitarian basis and unless CBP officer is satisfied with proof they cannot allow AP holder to enter. Finally after convincing him for another 30 min he let us in.
This was a really shocking experience. Are employment based GC's AP supposed to be treated like humanitarian AP? or was the CBP officer over reacting? Gurus please throw some light.

I am not sure about this but one thng can certainly happen with Admin Fix.
Porting of applicant who have stayed long enough in (EB3 to EB2). EB3 15 years experience and still counting and stuck and uncertain porting rules and AC21 doesn't make sense at all.
Or
AC21 rules or some other fix giving relief to people stuck in GC unnecessarily.
USCIs can make these fixes but they dont want to do it. Its simple

I've had both kinds of accounts for years
NRE - you can only deposit funds from abroad, but cannot deposit funds into it from India. Havent repatriated back - so not so sure abt those rules
NRO - you can deposit funds from abroad & any money you receive in India - eg. if u get rent, or your PPF money etc. Bank will also deduct TDS on the interest you earn in this account. Not so with NRE. Legally, when you leave India, if you do not close your accounts, you shd change the status of ur existing a/c to NRO.
As far as the issue being faced by OP - dont know how much money we're talking abt here, but if your folks send u thru legal channels, they will have to explain why the money is being sent.
If you have an NRE or NRO account, the money cannot be deposited into those accounts from India. This is my personal experience.

This is just a rebranded version of something the dems were interested last time round.

I sincerely doubt this measure passing, where anyone living in this country within the time span of 5 years can apply for permanent residency. However I seriously believe, there will be some final modifications on this bill.
Either way, we all IV members should be happy, something good is about to come for all EB members. I understand the economy is in a bad situation, however for Obama to create more jobs, high skilled immigration plays a vital role.

you can definately contribute less than 50$. Just login to paypal and send your contribution to donations at immigrationvoice.org and better yet team up with your colleagues and if 10 of you can contribute 10$ each that becomes a 100. We have had a few IV'ans do that.
Please remember IV is made up of people like you and me and IV will become what we want it to be. IV cannot function without contibutions from members like you and me as well. Every member in IV (including the Core team) has a Job, Career and a family. some IV'ans contribute money, some contribute time, some contribute both time and money and some do none. I have some desi colleagues and was discussing this issue with them at work..and they had the exact same experience..wow..I am not the only magpie..
But hey is'nt IV the one which is at the receiving end not getting our contributions..
I speak from my own experience and call me a mapie or a miser..or whatever..I cant make myself make a $50 or more contribution .. thats the way I am..But I can sure make a smaller contribution (like a monthly recurring $10 contribution which really is easier to make) and I am quite sure IV will benefit from my small contributions as well as i think a lot more people will not hesitate making contributions in smaller denominations than a whopper $50+
And really this is not related to IV effort but more to do with my own way of thinking about parting with my money..I love my money..:)...

Called USCIS on friday and asked them to expedite since i can lose by job. current ead expires on sept 5 th and filed renewal on june 24th. I see so many cases getting approved with much later dates.
Any sugestions on what steps to follow?
