    EB3 I is still very unfortunate... I guess this is how the melting pot works... correct me if I am wrong.

    Out of 140K Visas 7%= 9800 is assigned to India (All Categories)

    Out of 9800 - First EB1 then left over EB2 and Then leftover to EB3 :(

    From over all left over of 140K - First EB1 then left over EB2 and Then leftover to EB3 (all other countries) - Left over (EB3 China) - Left over to (EB3 India) :(

    EB3 India is lowest on the FOOD Chain!!!

    EB3 India is not unlucky but thats the default category for any one to apply when they or job doesn't let them go for Eb1/2.

    So the obvious reason is:
    when we have brand new lot of 85K H1s most of them apply for Eb3, and big chuck is Indian (no 7% cap here), but regardless of category, if 85k applies for GC, with one dependent it counts 130k.
    And for GC allocation we have country cap which is ONLY 7% when we have 70% applicants. Do the math, 85000*.7*2= 119000 applicants for GC from India each year and they are entitled for 140000*.07=9800 and now lets say with all favors from ROW and EB1 we got double say about 20,000 still there is a back log of about 100K each year.

    Thats assuming everybody applies for GC out of 85K H1 stock.
    Based on this I don't see EB3 to become FIFO or backlogless because the system is not balanced,

    D. VISA AVAILABILITY FOR OCTOBER

    The Mexico F2A and Employment Third preference cut-off dates are �unavailable� for both August and September, since those FY-2008 annual limits have been reached. The Visa Office had originally anticipated that this would be a temporary situation. Then with the start of the new fiscal year in October the cut-off dates would have returned to those which had applied during June. However, continued heavy demand in those categories may require the establishment of cut-off dates which are earlier than those which had applied in June. A formal decision determination of the October cut-off dates will not be possible until early September.

    I hope my previous post is not taken in any negative sense. I was only expressing my opinion. I believe in what IV is trying to accomplish and I have contributed to the cause. I was only implying my reservations to the fact that SKIL bill will be on some sort of fast track just because we are all waiting for 5 years. I was only saying requesting a small measure will go a long way to help us all, instead of looking for a big pay day from Skill Bill.
    There is a talk of border security bill that could be vehicle for our cause, provided we ask for reasonable measures.

    Looking at the table in immigration-law.com, it appears that 33% have been certified and 33% have been closed/denied of the present 67% that have been processed. Those are absolute numbers (it is not 33% of 67% closed, it is 33% of the total 330K). Hence of the 220K cases processed, 110K have been certified and 110K closed/denied.

    If the same trend holds, it will be 165K certified (out of a total of 330K). Add the 1.1 multiplying factor and we are looking at 346K total GCs. This is 2.5 years total. But USCIS seems to be sending off excess EB 1-2 visas to EB3 ROW so retrogression will continue for EB2 India and China.

    There is some massive confusion here. The Immigration and Nationality Act also says the following for EB3

    -Quote
    (3) Skilled workers, professionals, and other workers
    (A) In general
    Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (1) and (2), to the following classes of aliens who are not described in paragraph (2):
    -End Quote

    Read the term "Not to exceed 28.6 percent". So EB3 can't exceed 28.6 percent which means unused visas from EB2 cant all go to EB3. Since EB2 ROW is current, the unused EB2 visas should be coming to EB2 India & china as per AC21 law.. no?

    We shouldn't assume that USCIS is too dumb to follow the law..

    I am sure lots of people reading these kind of unbelievable recounts here and in the other threads have started contributing (including me). Are you guys getting any kind of numbers back from paypal, on what is the kind of spike that you are seeing in terms of # of people contributing in the last few weeks?

    Has it gone up from say, 100 to 1000? or has the new IV crowd been apathetic so far? A feedback from the core will indicate on what kind of response we have been getting.

    I hardly believe your story. Your written english doesn't seem like you are a H1-B guy form the other counrty unless you are from Canada. Why the f'ng game, what do you need? Now tell us another story that you are from Canada.

    @snathan, sorry pal i thought you must those fake identities in disguise who could pull you back from filing a complaint since they were one from the run, anyways with your suggestion the consular processing i understand there is a chance to come back, but to be true these 3 months have set me back by 3 years, with the consultant not picking my call when i want to ask him about the situation, running from company to company to attend an interview, they all taking a 5-6 hour interview and then then getting back 2 months later only to tell you that
    they had another senior in line from the company for promotion , they gave him the job and no outside candidates are being considered, other companies also making a mockery of the process of hiring. I would be better going to australia and working from within there, yes i did pay for my H1B but to be so true as i want to be i though it was a procedure at the companies and only realized after i had handed it over by reading this forum that i had also become in cohoots with this consultant. I am not a cry baby here , just that people flying in from all parts of the world , India, Australia, Canada and god knows from where, should be made aware that such things could happen to you and beware, for me the beware sign a little late as i believed at first started my research later.

    @poorslumdog when i started to research i found that this company has done this to many Indian guys, many Canadians by charging visa fees and charging some extra dough and sat on it like a vulture, did nothing to call them to the country and some have never reported to work after 3 years of visa filing, now why is this whole tantrum of filing then, they have been expanding with offices in various areas in US and it acts a good mark on
    their company in terms of view from a outside and successful visa filing with candidate money with no responsibility of placing then is a goldmine, they are like half hits in terms of placing and calling people here, i met with an Indian guy who had come here on his own and changed the company finally as he went thru the same scum of this company.
    Seems like there are victims falling for this modus operandi time after time.

    @GCvivek thanks for the analysis of my situation, i feel that its tough to put him to trial but somebody is going to have to do that someday, let it be me, atleast if only a black mark
    it will add to his database and track record of black marks and i am sure many more would have tried but never complained against him, makes him immune everytime someone passes without doing it as i agree they want to be safe, but i want to blow the whistle.

    I need help on the procedure of documents to be submitted , please help me on that as well.

    Can someone work for company A (with green card pending for 8 years) and start green card process thru other company to port to EB2(part time employment). Can they do that. I mean basically working for two companies until you get your green card, then quit company B and continue working for company A. Did anyone do this? Is this a possible scenario?

    when i spoke i didnt speak to normal CS rep they forwarded to me Info officer at Nebraska service center , now the key point is they clearly informed us that they have withdrawn the earlier notice and they said they have to open these july files. If they have just completed june filings they wouldnt have even touched july ones for sure. May be the ones returned which are very small in number are for casing whose dates are not current . for ex. if some one has sent app in normal pririty post expecting to reach on july 2 but reached early and got rejected it happened. so its pretty clear none of us have got the files back , all of three attorneys to comp said the same , my friends attorneys said the same , so we dont get in to too many things now , lets wait till next week or around 25th if we still dont receive then they asked me call back so that they can escalate this , she claims even when they reject they have to create a rejection letter and she clearly told that she was not aware that NSC did that type for these July ones.

    For my situation discussed above, I took an infopass appointmnet at Baltimore and they couldn't offer a concrete answer since the case is pending with TSC. They asked me to reply to RFE asking for extension and provide supporting documents. I'm not sure if that would be accepted and results in denial of I-485.

    I sincerely believe NASSCOM should not ask Bush to raise H1B cap while he is there. It will create unnenecessary rukus in the U.S. media, and critics may contend that foreign institutions are trying to influence US immigraton policy.
    Anyone with contacts in the Sofware Industry/NASSCOM please contact them (and Karnik) to let them know this will be counter-productive at this time. I'm not sure what these guys are thinking, sitting in their offices in Bangalore:(

    The National Association of Software and Service Companies (Nasscom) will take up the issue of enhancing the H1-B visa cap for Indian IT professionals during US President George W Bush's upcoming visit to India.

    The present annual cap of 65,000 H1-B visas for Indian professionals was far too low and needed to be raised substantially to meet the growing industry demand, Nasscom president Kiran Karnik told reporters in Bangalore on Tuesday.

    "Though there are no great issues with the US, we are concerned with the existing cap on H1-B visas, which continues to trouble us," Karnik said.

    He added, "This is something even the US corporations are concerned about and share with us."

    "We intend to take up the issue with President Bush during his forthcoming visit to India (March 1). Since the US administration too understands our needs, we hope they address it."

    "Indications are some moves are afoot in this direction," Karnik said on the sidelines of the second Sino-India software industry cooperation summit.

    Recalling how the number of H1-B visas for Indian professionals touched a peak of 195,000 annually not long ago, Karnik said the Indian IT industry would be comfortable if the cap was more than doubled from the present level.

    "We are looking at a cap substantially high enough to bridge the demand-supply gap. We want market forces to be the deciding factor as the Indian IT industry is the major user of the H1-B visa," Karnik pointed out.

    The other major issue worrying Nasscom is the social security system or totalization agreement for Indian professionals working in the US under H1-B visa.

    "Even the high fee structure for H1-B visas is concern for us because Indian professionals are made to pay up taxes for social security without any benefit. Since the H1-B visas are only for three-to-six years and social security benefits flow only after 10 years, Indians stand to lose out on them," Karnik lamented.

    To overcome the problem, Nasscom has suggested the US government could refund the tax deducted under the social security system at the end of the work permit on the lines of some European countries.

    "We are not against the deduction per se. Collect the social security tax, but refund the amount when the person leaves for home, as is being done by some Scandanavian countries like Finland and Sweden," Karnik affirmed.

    In fact, Nasscom is in talks with more countries to introduce a similar tax system for the benefit of Indian IT professionals going abroad on work permit visas for onsite work or executing projects over a long period.
    Nasscom also plans to bring to Bush's notice the urgent need to hasten the process of issuing H1-B and L1 visas.

    "We are not against safeguards for L1 visas, but new restrictions should not be adverse. We agree L1 visas should not be misused. But the process should not take too long," Karnik said.

    While H1-B visas allow companies incorporated in the US to employ professionals from overseas, L1 visas is more temporary in nature and is issued for transfer of an employee from overseas to the US.

    In this context, Nasscom hoped the opening up of a US consulate in Hyderabad soon would benefit the Indian IT firms in reducing the time taken to process their visa applications.

    Forum Gurus - I got a denial letter on my 485. I am a July 2007 filer and applied for AOS in July 2007. My 140 was revoked by ex employer in August 2008 and immediately I got a NOID from USCIS and responded to it in a timely manner and my case processing resumed.

    But now, I got a denial stating that my 140 has been revoked in August 2008 and thats why my 485 is denied. My Attorney is filing for MTR and says it is a mistake on their side and will be resolved through MTR.

    It just baffles me that the person who sent the denial letter never looked into the system to see my case trail and blindly issued the denial notice. My Attorney says, it is very much possible that they do not look at RFEs or responses - they just issue denials when they browse through the 140s.

    I am EB2 India with a priority date of March 2006. I think some kind of pre assessment is going on. There are no LUDs and mine is at the TSC.

    Is there anyone else in the same boat? How long does it take for MTR to get processed?

    Folks I have an update on my case.

    We filed for Motion to reopen on which were receipted on March 27th, 2009. I wrote to Congressman, Senators and also Ombudsman. Today my congressman's office got an update that our MTRs were approved on April 30th and our 485s got reopened and they have sent letters to that effect.

    What a relief. It was a stressful 6 week ordeal. Thanks to IV and its members for the help and support.

    The entire July fiasco and fix is nothing but a GRAND DISTRACTION.

    Let us go back to the June bulletin. The numbers became current and leaped by many months JUST AS the Immigration Bill was being debated. This resulted in the EB folks feeling temporarily elated and quite distracted with delusion.

    Then, comes the July bulletin. Making ALL numbers available made everyone ecstastic and completely distracted. This just as the debate was winding down.

    Again, two key 'relief points' that magically appeared just when the legal workers' needs could have been further highlighted. Net effect, the relative pain and position was REDUCED, so it appears that the problem was being fixed and hence not that urgent.

    Next, comes the EB bulletin fiasco. This completely derailed the community. The fix and elation in the past few hours has resulted in all celebrating a pyrrhic victory that will completely derail the discussion on EB issues.

    Like ripples in a pond, the net effect of these events has led to a complete refocus of priorities such that even temporary fixes are being toasted and celebrated.

    I am not suggesting that there is no silver lining in these clouds. The flower campaign, rallies etc have all been positive moves.

    Instead of celebrating ad nauseum and thanking each other and wondering how to send thank you notes... let us FOCUS ON THE REAL PAIN POINTS and PRIORITIES ... the end goal is a predictable system and process for Green Cards.

    Any interim relief, while truly and deeply appreciated, cannot be sold as the end product in order to buy our collective silence.

    I request the IV Core and others to please continue to highlight the need to get EB Green Card processing professionalized and predictable, in order to ensure that the respect for the law is reciprocated in equal measure.
