Sanju, with all these candies you are throwing at us, I am thinking that you might be the one my parents used to warn about (dont talk to strangers who offer you candies). So now I am very scared, you seem to have taken quite a liking to my thoughts, which scares me too (rest assured, I called dateline NBC too!, Chris Hansen is a nice person to talk to).

    You want to discuss more, well there is a problem, I am not a debater. I never won any debating contests. I see the points all of you are making, and, while I can understand where from it is coming. On a bleak day, I do commiserate with it - heck I do sometimes even cross over to play the devils advocate (Note: it is an expression, I am not saying we Indians are devils (I need to clarify, because there are some who take literal meaning at times)), but in the end, I have to come back to the quota being an enabler to control the "rush" of applicants.

    Some have said that EB is based solely on "merits", and that I am inventing my own intent (of diversity). No I am not, look it up. The per-country quota system is mentioned in the statues even before family or EB is discussed. Family based immigration have the per country quota too (why should an Indian Family suffer for X years, while families of other countries are able to unite sooner), but I dont see that we asked to remove the the quota completely. We only asked for removal in EB (but that is deviating from the topic).

    I am not anti-immigrant, just because I argue against some provisions does not make me anti-immigrant (well the same charge will be leveled against us by CIR folks because we dont take/support their approach), and no I dont yet have my GC. I may be whatever, but I will not burn the bridge after crossing it (though I have been known to burn the bridge while I am still on it).

    Yes, laws can (and shall) be changed, but can't we discuss the good and bad of what we are changing? I have seen many a legislation that have good intent at heart, but many times ends up without checks and balances (and eventually misused).

    I never got any LUDs but got a denial on my 485 after going through the AC21/NOID stuff way back in August, 2008.

    There could be some background processing going on.

    Is there are pattern to these LUDs?


    I am in a situation that the company where I am working is offering a permanent position and my employer is also willing to support me. But I am afraid of doing AC21 after reading about the pitfalls of AC21. Any suggestions??

    As I mentioned in one of my post not even 100 persons responded. It either means there is not much persons who are impacted by the memo or most are not interested. For many people to participate they will need to know the details and directions. But most update might be in donor forum. So I think in future IV will get good efforts from only donor members. But if enough donor members are there then that will be ok for IV to get success in any drive. Otherwise it will be tough as there will not be enough people for advocacy efforts

    But this drive might have added a few donor members. In that way it is good.

    I am in "Not in H1 and not affected" category but willing to contribute both time and money for this cause.

    Many of us are waiting to file I485. Think about them who have filed and are stuck in namecheck for 2 years plus or waiting for visa numbers to get current- they are renewing their EAD every few months (and guess what, they are paying extra money).

    Now that the atmosphere looks good for businesses (via increased H1Bs), people who either voted red or did not vote at all, are getting scared of possible democratic party actions.

    06/07/2008: Congressional Legislative Strategy Shifts from H-1B to EB Green Card Options for Recruiting and Retaining Required Highly Skilled Foreign Workers from oh-law

    * Report indicates that the H-1B visa cap adjustment efforts have been stymied by the legislative deadlock over broader immigration reform despite some bi-partisan efforts, and supporters of highly skilled foreign workers are focusing on exempting these foreign workers from the national annual limit for the employment-based immigration (140,000), particularly for the U.S. advanced degree holders, where these supporters can make the strongest case for keeping these workers in the U.S. with lesser challenges from opponents than the option to increase the number of national annual limit from 140,000 to either 290,000 or even 400,000. This strategy is evidenced by the efforts of Rep. Zoe Lofgren, Chairwoman of House Judiciary Immigration Subcommittee and Sen. Barbara Boxer in the Senate. As we reported it, these legislators have introduced several bills both in the House and the Senate to achieve the strategic target for enacting employment-based immigration relief for the business community. This trend is however not limited to these two bills. We have a bill introduced by Sen. Cornyn, another bill introduced by Sen. Norm Colman of Minnesota, a bill introduced by Rep. Kennedy, a bill introduced by Sen. Gregg to convert current Diversity Visa Program to the employment-based immigration program, etc.
    * Out of the foregoing bills, Rep. Lofgren and Sen. Boxer bills are expected to face less challenge from the Hispanic Caucus in the Congress in that these bills do not propose adjustment of the employment-based immigration quota and will bring about a limited impact on overall employment-based immigration reform goals to solve the overall currently broken employment-based immigration system, and these EB supporters should eventually join the comprehensive immigration reform supporters in the future to achieve the needed overall reform in the employment-based immigration system within the context of the comprehensive reform. Surely enough, current EB bills represent piecemeal immigration legislations with lesser impact on the overall strategy of the comprehensive immigration reform strategists. Reportedly, to seize a momentum to obtain supports from the national election candidates for the next year's comprehensive immigration reform, the Hispanic strategists and comprehensive immigration reform supporters are scheduled to mobilize massive rallies during the Labor Day holiday in September throughout the country and the country will be swirled into the debates of comprehensive immigration reform legislation rather than piecemeal legislation. Accordingly, unless the supporters of the pending employment-based immigration bills work hard and successfully pursuade rather than pressure the Hispanic legislators very quickly, the odds are not too promising.

    Hi SSA,
    Please update us on your I-94 # after you receive your H1B Approval Notice.

    I agree that whenever you apply for Transfer/Extension USCIS issues,
    the H1B Approval (I-797 Notice) with I-94 # same as the I-94 # you have
    submitted along with your H1B Petition.


    I haven't received the physical H1B approval notice from my attorney yet so I don't know what's the I-94 # on that one although I doubt it will be the same. AFAIK each I-94 number is unique and different. Anyway, I don't think I-94 number itself matters any, just the fact that you have valid, not expired I-94 is sufficient.

    I did not fill the forms for the transfer myself (the attorney did) so I don't know for a fact what he entered in "last manner of entry" but I'm 99.99% sure they must have said "Paroled" as they asked for my I-94 that had "paroled" stamp on it to attach with the petition.

    Finally, I did not get any RFE.

    Is Money Behind USCIS Move To Have Department Of State Take Unprecedented Action To "Update" July Visa Chart?

    Was the Department of State's unprecedented action on July 2, 2007, issuing an "Update on July Visa Availability" closing off visa availability for the rest of the fiscal year for employment based cases and essentially gutting its July visa bulletin (which opened the employment based categories EB-1 through EB-3 for adjustment of status applications) all about the money with U.S.C.I.S. in the role of culprit? We believe the answer unfortunately is "yes" and reflects U.S.C.I.S.'s desperate desire to grab its huge future fee increase from individuals that it saw slipping through its fingers. U.S.C.I.S. undoubtedly perceived its expected windfall of hundreds of millions of dollars through its outlandish July 30th increase in fees for petitions and applications (average increase 66%) threatened by the July visa chart which would allow many employment based individuals and their families to beat the fee increases. A typical family of four (husband, wife, child aged 16 and the other 12) applying for adjustment of status currently pays $1,605 to U.S.C.I.S. (including I-140 charge). That same family on and after July 30th would pay $4,105, an increase of $2,500, or 255%. If one multiplies those figures by at least 100,000 ( $250 million difference),[1] one can imagine the explosive temper of top U.S.C.I.S. officials when they saw the Visa Office July chart. U.S.C.I.S. has made no bones that it is depending upon the fee increases to fund its proposed systems and structures for the 21st century.

    The Visa Office made it clear through the updating of the visa bulletin that its update was only because of U.S.C.I.S. action using the phrases "The sudden backlog reduction efforts by Citizenship and Immigration Services Offices during the past month....", and "As a result of this unexpected action....." The Visa Office cited these efforts as resulting in the use of almost 60,000 employment numbers. It is also clear that the Visa Office had no wish to defend U.S.C.I.S. when it issued its update on July 2nd. Whether it retains its stance in the future of washing its hands and pointing the finger at U.S.C.I.S. remains to be seen in light of probable Administration pressure to spin the story in a more positive light to the government as this Administration has exhibited a continual attitude of "soaking" immigrants, legal or otherwise ( $25,000+ for a family of four to immigrate under the recent fallen Senate bill ( See our article, "$10,000 Required For Earned Legalization and Adjustment Under the Secure Borders, Employment Opportunity and Immigration Reform Act", http://www.alanleelaw.com/english/articles/a2007-05-26.htm), which figure was modified from the earlier Administration proposal of $82,000+ ( See our article, "Mr. Lee's Comment to March 28, 2007 White House Immigration Reform Proposal - Z Visas", http://www.ilw.com/immigdaily/digest/2007,0403.shtm in "LETTERS" section), the passed amendment to S. 1639 raising H-1B surcharge fees to $5,000 on top of the fraud ($500) and filing ($190) fees, and the rapacious July 30th U.S.C.I.S. fee increase). The author recalls his telephone conversation with Charlie Oppenheim, the chief of immigrant visa control and reporting, Visa Office, in December 2004 concerning the 101,000 "pool numbers", in which Mr. Oppenheim gave no credence to U.S.C.I.S. figures that the agency had cleared over 100,000 cases (including dependents) between April and November. (The exact differential was 115,000 cases, a rate of about 16,400 per month). The author has no knowledge of the exact number of cases that U.S.C.I.S. claimed to close in June for the State Department to announce that almost 60,000 employment numbers were used (employment based immigrant visa numbers are also requested by U.S. consulates and embassies), but notes that the vast majority of employment based cases are with aliens in the States who adjust status here rather than consular processing their cases. If U.S.C.I.S. claimed to clear anywhere in the area of 40,000-50,000 cases last month, that number for one month is difficult if not incredulous to believe, and if true would have involved massive shifts of U.S.C.I.S. personnel from other responsibilities to comb through and adjudicate all files of persons eligible to immigrate through employment, or less than careful consideration of the cases. Hopefully the agency was not in such a desperate state as to cut corners to endanger our national security if it was the latter case.

    The facts and the legality of U.S.C.I.S.'s actions will undoubtedly be the subject of multiple lawsuits. However this turns out, the agency and the Administration will wind up with less respect than before. This Administration needs all the good publicity that it can muster in light of its unpopular Iraq war and recent actions freeing Scooter Libby (not even Paris Hilton avoided imprisonment) and supporting Attorney General Alberto Gonzales and creating further public mistrust of the justice system even after confirmation that he and other White House aides politicized the selection of United States Attorneys. Unless U.S.C.I.S. and the Visa Office can change course, this episode will unfortunately become a black eye to all parties as further facts emerge in the coming days.

Just be happy for it...its just your need so that you can live in this country for as many year as you want and of course its good achievement and i am happy for you, you just lived here for 10+ yrs and you forgot your Home country where you were born and gave you a good education with you had an opportunity to come here and make your life based on that..you should be PROUD of that country no matter where you go and what you achieve its all because of you Home Country

    You're right. No offence but no authority seems to be listening to IV suggestions. I agree that people at IV are doing great job, but the problem is nobody is listening. They just don't care. And this think will go on & on. I remember s'body suggesting hunger strike and at that point of time I thought that won't work. But now it seems we have to go extreme and do hunger strike and stuff to pressurize this crappy system.
    EB3 people don't think I am being selfish here. The truth is we have to work unitely and pressurize for visa recapture. That will be beneficial for e'body.
    Lets target the 'Asses' asking for a kick. Let's all kick ass.

    I totally agree with you, I used to visit IV a lot, but was just disappointed with the results from some of its members. Not to blame IV core team, but other members who would just come and read blogs. Specially EAD holder's, I hope their eyes are opening up to new realities. Yesterday, my sister in law entered USA from Newark Airport and she witnessed three people holding HIB visas get cancelled at the immigration point, one had EAD.


    All we Desi's want is a free ride, same old mentality, don't want to put in any diligence in this matter, but very quick on pointing short comings on others. Blame game!

    Point is, we all need to do something radical, sending flowers again and holding a hunger strike, otherwise, keep coming to IV and keep getting disappointed.

    Papu, maybe you can hold something up for once. Schedule a date for some event.
