I am planning to shift employers and I have a question:
Company A applied for my green card and I have an approved I-140, passed the 6 month mark and now planning to shift jobs on EAD. I have an offer from Company B with a condition that my offer would be permanent upon approval of my green card. I cannot work for company B till I physically have my GC. In the mean time can I work for Company C ( in a completely different field) till my GC gets approved without any issues?
I am sorry, I don't have answer for your question, but the AC21 cases getting denial will certainly effect you as you are planning to use AC21.

i guess you would need to share specifics with a reputed attorney to identify what went wrong in your brother's case. on this forum, there is limited help for a case like yours that requires professional handling.

never though i could get so much experience with neurosis (mine and everyone else's) in a such a short time...guess i should thank USCIS- and apply for EB1 as a international expert :D:p
Paskal maybe you should call up USCIS NSC and ask them the names of all their Mail room clerks. Tell them ur calling on behalf of Homeland security!:p
Then call up UPS, USPS, DHL and Fedex to get the common times when the delivery trucks stopped by NSC to drop off applications and threaten to sue them if they dont give u exact details of number of applications dropped off with each delivery. Once again tell them its a matter of national security!!
Finally create a POLL of Delivery Times v/s Mail room clerk and combine all threads. ;)

If she uses her H4 Visa stamp to enter , will have to file H4 to H1 Chane of status to be able to work on H1.
I think you probably can get the H-1B stamped as well and have your wife enter as H-1B.

We live in business world. Bright Companies pay salary at bad economic times to retain skilled employees. Desi companies pay more even during bench to retain employees, american companies dont and lay them off. That is precicly the reason desi companies succeed.

Let's get some stats on how many employment-based green card applicants are from the state of California. Perhaps they are printed on a DOS, USCIS web site or report. I am sure the number is high (San Jose etc.)

I guess this community is not for willful violators like you. Here we are trying to share information from/for people who follow rules. There are many people (anti-immigration lobbyist and anti-H1b lobby) reading this forum. This will give impression as if this forum is for giving advise to people like you who do not care for the law and will give bad name to IV. I guess you should cough up some money and get advise from a good immigration lawyer. Also, I would suggest a moderator or administrator to look into this matter adn have this thread removed.

Yes, my presence in the past violated the immigration law, but it was due to circumstances that were out of my control. Your description of my story as "willful" violation is very judgmental and sounds like you feel righteous. But I bet you personally know someone who may have been out of status for one reason or another and I wonder if you are this confrontational and heartless with the person.
If you don't have words of encouragement or constructive feedback, then I suggest that you worry about your own. It doesn't take too much to get out of status given the current immigration system nowadays.

You say it is 50-50.
As per the cases that I have seen, it is 90(-ve) & 10(+ve).
My brother and many of his friends have been refused. The age of the doctors matters a lot. Young ones no chance.

It will not have much impact if any president comes in the case of immigration. Anyhow most of them are not going to Veto. It is the congress who plays important role. President can just initiate the process. Bush tried his best to pass some immigration reform but divided congress defeated all the bills. Who is the reason? Not just anti immigrants but also pro immigrant groups. Expectation from pro immigrants was too much and in some cases impractical. Anti immigrants used those and defeated every time. Also anti immigrants used division in various groups like legal vs illegal, high skilled vs low skilled and H1 vs green card. Some unbiased leader need to bring a bill which should work compromise at the same time that compromise should benefit all the groups. But unfortunately most congressmen are busy in other works. Next congress is critical for any immigration reform

First thing, price , leg space, comfort & food ...All 4 it is difficult to get the best.
Cheapest would be air India. However service/food is bad. Also they keep changing schedule.
Singapore airlines/Cathay pacific service/food is good. Leg space is also better and
priced slightly higher than AIr India.
So I recommend these 2 (Singapore/Cathay)

I disagree with fee reduction. In fact I believe they should increase it and give poorer service as they always did.
AND visa/EAD terms should be reduced to 3-6 six months so that people renew more often.
Also how abt increasing the SS deductions on H1B/L1 guys? They dont need to give that back anyways. Most people even if they get GC/CITIZENSHIP will not live for more than 67?
In fact above idea will bring US out of recession.

Could you enlighten us? Also, what do you mean by Happy & Unhappy scenario, only one of them as to be the legit way, no?

I guess employer need to revoke unused H1Bs as part of H1B rules. Maybe that is the reason employer revoked past H1Bs to keep their side clean.
I remember reading Murthy bullettin where she mentioned back-wages are an issue if H1B is not explicitly revoked.

My previous attorney also mentioned the same thing. Looking at this thread it seems all soft/hard lud's were generated on Sunday, April 26th. Maybe a computer program flagged these cases.

Lisap - The GC approval will depend on your Priority Date. The more recent your PD, the longer it can take for GC. In any case, I think it's a safe option to get your H-1 extended unless you want to take the risk to wait for your EAD.
