This is the best news I have heard on the immigration front this year. I have waited for my GC processing for the last 5 years and seen numerous people buy labor cert and get their GC in few months. The GC process stinks due to the labor substituion process. I feel bad for all teh desi companies who run on the model of selling labor cert. I hope they all rot in hell. Sorry for the rude post. But most people can see my frustration from the process.

What are you talking? which part of the world do you belong? Obama is the democratic candidat for 2008 Presidential Elections Its conformed.He is not still fighting and also he how can you justify that he is a weak person? do you know he was no where in the picture and no one expected he will won the nomination when the Democratic Primary was begun..now he is the democratic PRESIDENTIAL NOMINEE..by now you should have undestand how powerful he is.
Weak or strong, either he (or Sen. McCain) will be president, and not king. They may have a strong influence in the Congress, but they can't boss it around. Specially since a minority in congress (be it Democrat or Republican) has its own way of stalling bills they don't like. I hope next president brings sanity back to the Washington.

I can understand where you are coming from...with only few people participating in the core efforts and many people commenting on the efforts online. I can agree to that part.
However, we must not under play the fact that an organizations of need-based and issue based type ALWAYS has floating members.
For example....if your GC gets approved tomorrow...I'll bet that you'll not care less about the forum.

A lot of persons have refused to join IV efforts with the ruse "IV is just an online forum where members discuss mundane matters". Whether someone admits it or not, IV has a serious image problem !. Friends, I understand the concept of marrying before and after 485.
My question: Lets say I go ahead and apply for 485. However, my H1 has expired, so I will be traveling on AP. So when I travel outside the US, I am technically not on H1, when I come back...am I right? So, if my spouse wants to apply for H4 visa will she be granted one? Since I had traveled on AP? I am sorry if I confused this with EAD. Bottom line, my H1 stamp has expired and I do not intend to go for another stamping while outside.

To raaj2007, just getting an EAD does not nullify your H1, but if you use EAD you loose H1. Go and check with your attorney. If you use EAD you cannot enter US using H1 or H4, you have to use Advance parole.

In that scenario you ask USCIS to send US consulate in India to send a notice that the principal applicant's 485 has been approved and since the marriage was before 485 approval, she should be called for Interview at the US consulate in India and given the immigrant VISA, The Follow to join process is like Consular Processing.

The intent of the H1B program is not to bring people in the country in "Anticipatory mode" as you put it. The intent of the H1B program had always been for US employers to hire foreign skilled workers "On-Demand" when no american is willing, qualified or able to do the said job. Prior to 1999, the visa cap was 65000/yr WITHOUT the extra master's degree cap we have now, and still visas were never totally used up for any year, certainly not on the first day. It is only after the advent of the IT consulting companies hoarding visas in "anticipation" of future jobs that the problems started. Without any restrictions on this kind of abuse, no amount of H1 visa increase would be sufficient. They are talking of raising visas to 130,000 right? Based on the FY 2008 applications, those visas would be used up in TWO DAYS!
IMHO, the intent of the H1B program is equally important than just loopholes (or not) in the letter of the law.

I am glad IV is focusing more attention on the name check nightmare. I filed 485 in December 2006 (EB1) and am stuck in the namecheck.
Namechecks:
IV will be soon posting some updates on this. We have done some ground work on this issue in the recent past and have got positive response. Stronger support from our members, will definitely help us push this agenda item. IV feels that this issue is going to be a big roadblock for a lot of us now, after people have filed their I485s. It is possible to get a much wider bi-partisan support on this issue by us and we are already pursuing it.

I am not sure under what BILL they have a provision to remove US degree holders from actual Visa Numbers...but, we should also keep fighting for that because this would have two fold benefits:
1. All US degree holders will be benefited.
2. These US degree holder Numbers can be used by Non-US degree holders.
As everyone knows, most of the students will be unmarried when they enter the country for there degrees...and apply for GC after getting married....so, definitely if these numbers get eliminated from the actual visa numbers we would have double the numbers available for non-us degree holders...what do you guys think..????????

some states do consider a foreign student as in-state after one year of residence. but for some other states that you have not been to, if you come on F1 visa, you are international and therefore out-of-state no matter how long your program is..

Where can I find medical insurance for my parents with reasonable coverage with reasonable premium. Their age is between 55 to 60. Obviously they are with some medical conditions like blood pressure, diabetic... like usual stuff like typical parents would have...Can somebody suggest good one... thanks in advance.
