    Got to hand it to you man, your comments are Hilarious. You heard this .."Fool me once, shame on you; fool me twice, shame on me". You said USCIS is screwing you you by giving H1 and GC to these lesser degree fellas, and shame on them for doing this, yet you stand in line to get screwed by USCIS, everyday, again and again. And you are standing in line for what? the past 10 yrs only to get screwed everyday. I don't understand the desperation. Anyway, hope you get your GC soon. I don't know which is more fun for you, getting GC or standing in the line.

    They either have to reject the application or provide the receipt notice. Cannot hold the applications without any actions for long time.


    This can reduce the impacted percentage to people from Retrogressed Country /Category ...

    May be some thing we can ponder on ....

    I'm not working in the IT industry and this is the first time I have some idea about what the desi companies are doing in US. Yes, I think these desi companies and people who conducted those fraudulent behaviors are partly responsible for our situation here. I believe most H1B holders are decent people while some like those mentioned in the article are nuts. Bad purges good. Now all H1b holders have to pay the price.

    Besides, I think those who conducted these fraudulent behavior do not deserve to be called "high-skilled workers".

    H1B problems have nothing to do with retrogression.

    If H1B employees are being mistreated by a certain class of employers, then what does that have to do with shortage of visa numbers?

    Nothing.

    Misuse and abuse of H1B program did not cause retrogression. And if the abuse ends, its not going to end retrogression. The H1B program does provide ammunition to anti-immigrants to use that paint-brush and paint the entire program of H1B and Employment based GC as bad. Fortune 500 companies dont engage in unethical behavior. The TCS, Wipro etc maybe do that. Small bodyshops certainly do that. I am yet to see a small body-shop, operated by a citizen of foriegn origin, working by the book and treating employees well.

    But all said and done, these things make our life more difficult and exacerbate the situation that arose from retrogression. However, these things didnt cause retrogression.

    At the most, these issues of H1B abuse may have provided support to some groups in keeping the H1B quota down. However, it has nothing to do with EB quota. In fact, IEEE-USA advocates bringing down H1B quota and RAISING the employment based GC quota, in order to remove factors that encourage employer abuse.

    Well Said! I support you 100% and agree with you totally about this. Fraud is any program is unfair and unjust on everybody, including the H1 holders themselves.

    Your company is not a sample of the entire population. The H1B program is not on-demand program. It is once in an year annual event (because of the demand). US based companies when they get a new project which needs a position, if they cannot hire locally, cannot get H1B worker from overseas when they want. So, in anticipatory mode they have to get some numbers and utilize them and we do lose some H1B visas if they cannot bring them for various reasons.

    Is it fair, may not be. Is it widespread waste, I don't think so.

    Coming to market reality - how many US workers will join a desi consultancy company or India operations based company?

    There was a topic where googler had explained that as per DHS employee, unused Eb2 Worldwide goes to Over subscribed Eb2, so Eb2 India and Eb2 China.

    It appears that the policy was always this, but since there were no excess Eb1 in the last couple of years, there was no spillovers in the last 2 years, howeever this year there are higher number of unused EB1.

    In fact the way it appears is :

    EB4 unused ==> spills over to ==> EB1
    EB5 unused ==> spills over to ==> EB1
    EB1 unused ==> spills over to ==> EB2 world wide.
    EB2 Worldwide unused ==> spills over to EB retrogressed.

    So before any spill over to EB3, visas are given to EB2 category.

    Since the unused EB2 visas are given to retrogressed countries, I believe that more visas are used by country that has more retrogression. But if there is any future movement in EB2, than both India and China could experience it.

    From www.immigration-information.com forums, it appears that one of the important driving force behind the visa usage is the actual adjudication of cases from USCIS. Since generally USCIS does not really process enough cases to use all visa's(to ensure they are not wasted), every year there will be a need to have substantial movement in the cut off date to generate more demands for visa's, not just in AOS, but also CP.


    OK. So I am not all by myself in thinking on this. So there must be a good number of EB-2 Visa numbers available in the final quarter for the retrogressed countries.

    You can change your background if they want too... mine took like 3 seconds to make. People know we're voting for skins, not backgrounds.

    I was also unable to find a state chapter just a few months back. So I started one. Now we have around 60 members. Someone needs to take the initiative and set the ball rolling. That someone can be you.

    Any updates?
    I checked my former approved H1Bs and found:
    1) The Sept. 2000 approved H1B with LUD of June 2007
    2) The Feb.2003 approved H1B with LUD 0f April 2006

    For both cases, it seems the status is the same as when it was approved in Sept. 2000 and Feb. 2003, nothing new. Maybe these are automatic updates by the computer system.

    I read through the bill but don't quite understand...if I am working for a client on H1B, will I need to stop working as soon as this bill takes effect? or it only applies to newly applied H1B's (or extension/transfer)?

    Yes, that is my understanding at this point based on the language . As soon as the bill goes into effect, you will need to stop working at the client site if the bill passes in its current form AND you are working as a FT employee (w-2) of a mere placement company (aka agent or desi consulting). If you are an FT employee of big consulting company then until they get waiver for you AND your current client proves that no layoffs were done at the client site in the last 180 days, you will need to stop working.

    Looking at discussion going on here, its sure that IV have financial problems & only 5% (of total 8000 members) are contributing for the cause. Now, if we restrict IV website for "paid" visits, dont you think that IV membership is reduced by 95% to only 400 paying members?

    Instead of making "Paid" web site, I think Moderators needs to delete derogatory posts & block such userids.

    That is not a good option that would stop/reduce new members significatly, when IV goes to DC to represent our self, we have to say ' we are only 400 members ' There will be lot of difference in infuence factor when we are saying we are 400 to 8000

    So you guys are saying that because you are on a H1B you are working harder than others? Let me tell you that working hard does not guarantee your job. I have seen hard workers laid off left and right, be it US citizens, green card holders or H1Bs. In fact one of my GC friends said that it is a constant fear for him to be employed at all times, he was unemployed for 10 months after the dot com bust. That changed him completely, he said what will I do with my GC, can I feed my kids with a GC? I need a job. So it is everyone's perspective. I look at him and say at least you have a GC, he says at least you have a job. :)

    I still think that GC is not a right. It is a privilege, as is a driving license. You have to pass the drivers test to get a license. Logiclife's message from centuries back about anyone being able to move to another country does not work in today's world. There were no visit visas needed to get to India or China for example in those years, but why is it a requirement to have a visa to visit India now? Things have changed.

    BTW, I do think we should do what we can to improve the immigration process, but if nothing gets done its not the end of the world. We can "ask", "request" Congress to change laws. But surely you are not saying we "demand" for our rights to have a GC?

    Hi All

    I have been following this thread for the last few days and wanted to share some info. Hoping it would be useful.

    I entered the country in Jan 08 using the AP while I was still working for my GC sponsoring employer. Then in June 08 I joined another employer by transferring my H1B to the new employer. I did have the option of using EAD but I wasn't sure if the renewal will come before the expiry of current EAD. So decided to transfer H1 and my new employer graciously agreed to it.

    We did a premium transfer so got the approval in 2 weeks. Money does wonders (Almost like the proverbial paper weight with files). I confirm that the I94# number on I797 approval notice is same as the I94# number I got when entering the country in Jan 08.


    So this should be a good news for folks who are trying to do the same. I am in a different boat right now. I have to travel to India this November. I plan to return using AP. But now my employer is different from my GC sponsoring employer. Another issue is that I am going only for two weeks while my wife will be in India till Mid Jan. So we will enter US separately using AP. Please share your thoughts if you have been in this situation.

    Does your new I-94 (after H1 transfer) shows H1B or parolee? If you have time get H1B visa based on your recent H1B approval notice and enter on that. Otherwise you can very well enter on AP, though you work for different employer. As long as 485 is pending and if you have valid AP in hand, admission will not be an issue. Keep your H1B approval notice and AC21 letter (if you have it) in hand, in case if they dig you more.

    I didn't meant to hurt feelings here. and i know how Canada is less opportunity for IT folks. but just couple more points.

    1) if number of jobs was criterion, India has far higher number of jobs in IT then US, so people should be rushing bk to India which is not the case. I don't think number of Jobs available in US is why people wanna live here. Even if it takes year or a little more, at least Canadians are transparent about the process.

    2) I know everyone here is well read and well educated. Read up about AUS, NZ, Canada and few other countries which have point bases system, they are not under developed or backward in any way. Wikipedia might help.

    And please read carefully, my wife is on another beauty of a status called H4B, i mentioned clearly i know how easily people got their H1B's through consultants.

    Once the Break is Over in 2nd week of September, We all should call members of congress , as many as possible, to get their Support for Visa Recapture Bill. If that bill passes, it will help all the EB categories.

    I totally agree with you. I think we should call DOS/USCIS to complain about this. I will ask as many as EB2s to do the same.

    Why are you so surprised? If you do get permanent residency then too your prospective wife will not be able to immigrate immediately.

    Why do you think that i was 'surprised'?? I was just making a point that this policy was absurd!
