Well, I don't think I am at the end of line of 300,000 people. There must be lots and lots of people whose priority date is after April 2004 might have filed. This includes 2004, 2005, 2006 and 2007.
So I think 3 years is intelligent guess. But who knows I am just trying to make myself happy and trying to stay positive.
Also remeber there is a big number of LC BACKLOG cases, all with PD prior to 2005, that will be cleared by end of next month and would get to apply AOS some time soon.

I applied for PIO card for my son and daughter and both was rejected as both me and my wife are Indian citizens. I was under the impression that kids who hold PIO card need not have to pay NRI fees during college. Is this something true?

Nixtor, If you are Indian it seems to me you have not visited India for long time now. India�s IT story started as back office. But now that�s not true any more. The Kind of projects the big IT firms like Infosys, Wipro & Satyam are doing and no sub standard than the projects U.S. big I.T. firms are doing. But I do agree with you 100% it is a far dream that India can ever be at the top of the world. It is my personal opinion too. I think the current surge is temporary which was mainly brought in by a government which ruled India between 1999 & 2004. What we are seeing now is momentum of the good things they did. Well, I like you because you are just a straight shooter. If you are such a straight shooter then let me do some straight talk, so just catch this.
Your American mid-size company or Desi small size or super size company will get $180/hr but you will not get even $50/hr from the same client even when you go direct. So no matter how "highly-skilled" you think you are, your non-compete argument is not good enough for you not to be able directly market yourself, because there are gazillion other companies using BI, Cognos, BO, Informatica, Datastage and every similar crap. You can impress a few people by naming some technologies that maybe hot but they don't mean a &hit if you market them yourself. Here is why. A lot of people blame the lack of GC as a reason to be exploited. That is part of the problem. The other part of the problem is that most hiring managers in large companies get commission from these small, mid-size or large American, Desi or European consulting companies. That's why in most cases they always hire through one of these companies. They will not hire directly because the manager thinks you to be a stingy desi, and if he hires you directly the hiring manager will not see a dime, so why will he hire you directly? This is a big cycle of corruption and everybody is part of it including lawmakers who get contributions from lobbyist/representatives of these small, mid and large size companies. You think lawmakers don't know what is going on? You think client doesn't know that you make 85K when the middle company get $180/hr? You think the big-bosses at the company/client doesn't know that the hiring managers are getting favors from middle companies? You think lawmakers doesn't know that immigrant worker waiting for long delayed GC is bonded to an employer that buys employee retention insurance policy for the employer? They all know it. Diversify to more ( but related ) skill.
Add niche like PMP / Six Sigma.

I am sure he has heard of IP hiding techniques. If I were banned based on my IP, and I consistently want to post dividing threads on IV, would I not use a hidemyip plugin or post thru one of the hide my IP websites?

in the month of april my wife and I had received RFEs for 325 and birth certificate, we submitted the evidence and there was soft LUDs for almost a week, case status said a decision will be made in 60 days. I t is more than 90 days, so I called up the customer service (I very well know that they can't issue GC as the priority date is not current) I spoke to her as a layman and filed for a service request. Here is the email that I got:

I have to say that in that case, go ahead and at least file for your green card, that way you create one more option of applying through family based, even if it means 6-7 years of waiting period. Ideally you would like her to come to states at least for 2-3 business days to get court marriage and filing of docs, but if thats not the case then this is your best option.

I have a couple of questions, pl let know if you have valid info.
Situation: Spouse came to US on H4 and then got converted to H1.Due to delay in pay and not a strong case, she is not willing to go for H1 visa stamping next time when she goes to India. She wasnts to go for H4 visa stamping instead.
1. Is it better to convert to H4 here and then leave for India? We feel that if it would take time to convert to H4, then instead of waiting she can work till the last day here and then quit and leave(because she wants to leave ASAP). Also changing from H1 to H4 here means submitting paystubs and other documents and more scrutiny. I think in Chennai consulate there will be less questions if applying for H4. Any thoughts, pl help?
2. If applying for H4 in Chennai, will they ask for paystubs from her previous H1 status? They shouldnt since she is applying for H4, but I still wanted to know. If they ask why do you want to change back to H4, what is the best answer?
3. Travelling on an expired visa from East coast to Chennai. If there is no time to get transit visa to travel thru Europe, which is the shortest route/best airlines to get to Chennai quickest from say, Atlanta? Pl help

Eventhough USCIS center system accepts the finger prints, FBI system may reject for the quality of Finger print reason.In that case one can get another notice.I did read this some where in FBI or some immigration attorney's FAQs.If I re collect I will post the link.

2. Only applications which have a RD within the processing date and whose PD is current, are processed.
As per the uscis approvals it was all happening randomly,,sometimes they stick with rules and sometimes not..ofcourse PD should be current but ProcessingDates vs 485 RD its still stands a mystery.

How about if I send in Ac 21 paperwork and still be on leave of absence from my present company which sponsored my GC. It only gives me peace of mind because in case the new job does not work out I can still come back...
If you will be using EAD for new job, stop worrying about vacation. EAD is a "AOS" state meaning you are legally allowed not to even work so you can very well take vacation and even decide not to work till you get the green card. If you are playing "h1 transfer" then your vacation may become tricky if you do not get salary for that vacation. It may have an advese effect down the road. If I would be you and have decided to use H1 transfer then I would not go to unpaid vacation. If you will be paid for the vacation you will be fine for that too.
