    Incorrect. Please go back and see old threads for action items. Just because you do not see any action item right now, you cannot flush down all our hard work in the last 2 years. You are enjoying your 2 year EAD because of the hard work of our Admin fix campaign in 2008. Please stop blaming the organization. If you wish to lead it, come forward and take charge of your state chapter as a start, lead and deliver results. IV is everyone and each member's responsibility.

    kudos to what u accomplished in July 2007, but the reality is we haven't seen any major action after that. I guess its mostly frustration from ppl here, who think that the US housing/EB crisis can be pursued aggressively than expecting for CIR to happen.

    I am not so sure if the CIR bill will help us. Allowing 12+ million illegals into the same system that we are in will totally screw up our chances of getting green cards. Does the bill mention anything about increasing budget and manpower for the USCIS department to handle 12+ million potential applications? Considering that large numbers of the illegals are from a country which also has a specific country quota in the GC lines, will the bill increase drastically the number of Visa Numbers available??
    This bill favors the illegals so much that even reading it makes me wonder how fair the system is to those of us who follow laws and file documents on time. What's the point? All of us should just forget about the rules and go do whatever job we want to do.

    Hi

    I have a question regarding an appeal I did a year ago for a rejected LC.

    I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help.     She will be in AOS Pending status after Oct 1st, 2007 due to pending I-485 application. EAD does not provide any status.

    What is your status? I assume H1-B. You can file for H1 and H4 extensions.

    I have applied for my H1b extension back in April......Have not heard anything yet........once I get my H1b approval, can I apply for H4 extension from inside the country?? (Is that even required if you are already in AOS pending status?)

    I agree with Mihir. It is your life and you have to be always plan for the worst case scenarios, especially when we (legal immigrants) do not have any god father.
    First and foremost, if you lose a job, it doesn't matter what your immigration status, life is going to become difficult for you and your dependents.

    I lost my job in the 7th year of H1 but since I had well researched and planned for that scenerio before entering into the 7th year, I am still here in a new job with an anticipated 3 year extension from 2007-2010.

    If a lobor from your previous job has been pending for more than 365 days, you are able to port the benefit of the 7+ year extensions to the new job. This will let you survive the 7th year job loss.

    previously-approved I-140 petition. Many employers nowadays are choosing not

    Job Change - Transfer of Original Priority Date
    This is not related to AC21 portability. This is very useful in a case you are planning to change jobs or you fear that your employer may be thinking about laying you off or firing you.

    If the person has an approved I-140, but I-485 is not filed during priority date not being current, and decides to change the job, either with the same employer for a different job or with a new employer in a new position, the green card case would have to be started all over again, including labor certification(if required), I-140 and I-485 (or consular processing). However, if the person had an approved I-140 from the previous job, it is possible to request to retain the priority date in a new I-140 petition.


    You can change jobs when I140 is approved and I485 not filed but the new employer will have to start GC process from scratch, but you can retain old PD. You can also check with attorney if you are still doubtful.

    Any clarifications why India EB3 is behind mexico?

    1. May be there are more Indians in 245(i) cases than mexicans.
    2. May be lots of Indians have applied 245(i) cases eventhough they are not illegal. I heard that this is possible and you can use this to any future employer.

    Any comments.


    This question has been bugging the HECK out of me as well. I mean the only way this makes sense is if 245(i) + EB3 for India >> 245(i) for Mexico. Now from all that i have read/heard/seen, it seems like 245(i) is the major hurdle. Then how is it that EB3 India is stuck and everyone else is moving? The above equation must mean that there is a SIGNIFICANT number of 245(i) cases from India as well. Any thoughts anyone? :confused:

    I never understood this "exploitation thing". This is America...

    Exploitation is employer(i.e consulting company) takes 30 - 40% cut from billing from people on H1 but is ready to work on 5-10% commision with people with EAD or GC . (this is no exaggeration talk to EAD/GC guys & you will find many)

    If someone is exploiting we all have a choice. We can change employers; go back home, etc.


    It may not be a totally open market but it is not like you have handcuffs around you. This type of talk of exploiting, slavery only hurts everyones cause.

    Changing employer means start over GC process again unless you have 140. with 140 too many people are not very comfortable switching.

    Well, I don't think I am at the end of line of 300,000 people. There must be lots and lots of people whose priority date is after April 2004 might have filed. This includes 2004, 2005, 2006 and 2007.

    So I think 3 years is intelligent guess. But who knows I am just trying to make myself happy and trying to stay positive.

    is that true?



    i need big help with my 140 filed in Premium Processing
    and i did not get my receipt to file 485
    applied it on Jun 20 2007 (this month)
    any way i can get some copy of the receipt to file 485?

    No you don't. You can file without 140 receipt, atleast that's what my lawyer told me. Anyways, mine is concurrent filing.

    500000 legal immigrants, even if u assume 4 per family , ONLY 125000 houses can be sold...(even if 50% qualify for a loan.. thats just 62500 houses sold.. last i read..there were millions of homes for sale)
    if the average cost of the house is 250000, thats additional 31.25 Billion $ in credit borrowing... where is the money?

    Welcome back UN. One question. Does the USCIS have ability to check credit histroy.

    There is nothing in the law; where USCIS can deny a person's 485 due to bad credit. Therefore, they wouldnt' have any interest in checking this.

    They are on record that they will check publicly available information in help adjudicating cases. They usually; do this on h-1b petitions. They'll check the company web-site; company registration; whether office is in a house, virtual office, web-site of company giving purchase order, etc. They frequently quote whatever they find in denying cases.

    I actually came across a case where a company had 14- denied for ability to pay.

    There was a merger between companies and the new company filed the 140 using old companies labor.

    In denial; USCIS said they didn't believe the merger because a search of the california business portal showed that the old company renewed their business registratoin (evidence that it wsas still in business);

    since, president of the company had same name last name as person being sponsored; USCIS actually retrieved the president of the companies greencard applicatoin from 10 years earlier and quoted that the candidate and president were brothers because according to their g-325a's they had the same parents. They denied the ccase and invalidated the labor due to this.

    I remember back in 1994; IRS said that they were going to check peoples credit applications and comparing to peoples tax returns; they were going to try to compare the income people listed on their tax returns to what they were putting on their credit applications.

    If USCIS was going to try to get credit files; it would be in order to compare work/address history with what a person has put in their applications. However, they have a lot of other ways to verify this that they wouldn't need to go to a persons credit file. I know with the economy the way it is; people seem to be worried that declaring bankruptcy or having negative credit history affects their 485. However, not paying debts isn't considered criminal that it would impact a persons applications.

    Ahh, I was wondering what happened to the nay sayers. Here we go again. I agree with the general consensus that owning a house is a personal matter; depends on each person's own situation. I am amazed by why some folks are hell bent on making others agree to their extreme opinion; be it "yes you must buy" or "no you must not buy". Everyone is correct in what they think is right for them. For the record, I don't own a house, at least not yet. :)
